Absent: CouncilmemberBeyer. <br /> <br />Case #lA: Request for Site Plan Review of C.R. Concrete Design; Case of Rick Burnham <br /> <br />Community Development Director Sherman advised that Rick Burnham has requested that this <br />application be removed from the agenda. <br /> <br />Councilmember Haas Steffen asked the City Attorney to address whether there is a time limit on <br />this case and Agenda Item 7. <br /> <br />Case #lB: Modification to Diamonds Sports Bar Site Plan; Case of Gary Gruber <br /> <br />Zoning Administrator Frolik explained the owners of the Diamonds Sports Bar & Grill, Inc. have <br />approached the City with a request for some modifications to their site and landscape plans. The <br />first issue is the request for an accessory building on the site in which to store equipment <br />primarily for grounds maintenance. The second issue is the landscaping plan which has two <br />parts. The first part is Mr. Gruber's proposal to eliminate the 30 trees required to be planted <br />along the T.H. #10 corridor. The second part is a request to replace the vines to be planted along <br />the perimeter of the chain link fence with tree seedlings. Public hearings are not a requirement <br />for site plans or modifications to site plans. However, several residents had expressed concern <br />for the development project at the public hearing held for the issuance of a conditional use permit <br />for the outdoor recreational activities to be conducted at the site. Staff notified these residents of <br />record of the proposed site plan modifications to be presented to the Planning Commission on <br />October 6, 1998. Ms. Frolik stated that on October 6, 1998, the Planning Commission heard Mr. <br />Gruber's proposal for the addition of an accessory building to the site and the landscape <br />modifications. With respect to the 400 square foot accessory building, Mr. Gruber is proposing <br />grooved plywood siding painted "barn red" to match the trim on the principal building with <br />asphalt shingles on the roof. City Code establishes that all exterior finishes in the Commercial <br />District shall be natural or prefabricated stone and any deviation from that is at Council's <br />discretion. City Code restricts accessory buildings in the B-3 Highway Business District to 30% <br />of the gross floor area of the principal building. The principal building exceeds 8,000 square feet <br />in size and the 400 square foot structure will be well within Code restrictions for accessory <br />building sizes, as well as the 35% lot coverage restriction. Mr. Frolik stated one resident from <br />Alpaca Estates expressed concern for the proposed modifications to landscaping, particularly <br />replacing fence vinery with tree seedlings. After a lengthy discussion, the Planning Commission <br />tabled action on that portion of the landscape modification and Mr. Gruber was directed to <br />prepare an amendment landscape plan for the Planning Commission's review at a subsequent <br />meeting. With respect to the request to eliminate 30 tree plantings required along the T.H. #10 <br />corridor, the Planning Commission recommended that the number of trees to be planted be <br />reduced from 30 to 18 and that they be planted along the west property line to intensify the visual <br />and noise screening from the Alpaca Estates residents. The basis for this recommendation to <br />reduce and relocate the number of tree plantings is based on the fact that, through a self-imposed <br />change in construction methods, numerous trees were preserved on the site, especially on the <br />T.H. #10 corridor, and the Commission did not feel it was a priority to screen the facility from <br /> <br />City Council/October 13, 1998 <br /> Page 9 of 22 <br /> <br /> <br />
