Case #5: <br /> <br />Request for a Conditional Use Permit to exceed the Maximum Single <br />Accessory Structure Size Restrictions; Case of Scott Lebakken <br /> <br />Zoning Administrator Frolik reported that on October 20, 1998, the City received an <br />application from Scott Lebakken for a conditional use permit to exceed the maximum <br />single accessory structure size restrictions on his property at 14100 Germanium Street <br />NW. Mr. Lebakken's property is .9 acres in size and is restricted to a total of 1,499 <br />square feet of garage and accessory building space. In addition, there is a 624 square foot <br />size restriction on any single accessory structure. Mr. Lebakken currently has a 528 <br />square foot attached garage. He is proposing to construct a 960 square foot accessory <br />building in which to store his personal recreational equipment. The addition complies <br />with the parameters for total garage space allowed on the property, but it will exceed the <br />maximum single building size restriction by 336 feet. Ms. Frolik stated that Mr. <br />Lebakken has said that in order to comply with City Code single building size <br />restrictions, he would have to build a 624 square foot detached garage and increase the <br />size of his attached garage by 336 square feet. If he puts an addition on his attached <br />garage, it will prohibit access to his detached garage. She pointed out that the City has <br />approved overages in building sizes in the past. There were no verbal or written <br />comments during the public hearing conducted by the Planning Commission on <br />November 2, therefore, approval has been recommended. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt <br />Resolution #98-11-283 adopting Findings of Fact #0480 relating to a request from Scott <br />Lebakken for a conditional use permit to exceed the maximum single accessory structure <br />size allowed on parcels one acre or less in size. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen, Haas <br />Steffen and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt <br />Resolution #98-11-284 approving the issuance of a conditional use permit based on <br />Findings of Fact #0480 and declaring terms of permit for an overage in single accessory <br />structure size restrictions. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen, Haas <br />Steffen and Zimmerman. Voting No: None. <br /> <br />Case #6: Request for a Home Occupation Permit; Case of Renee Juliano <br /> <br />Zoning Administrator Frolik stated that the City received an application from Renee <br />Juliano for a home occupation permit to establish a hair salon in her home at 5163 - 146th <br />Circle NW. City Code restricts home occupations to 20% of the gross floor area of the <br />home. The room in which the home occupation will be conducted is 110 square feet, <br />which equates to 5% of the gross floor area. Ms. Juliano will be the sole employee and <br />she expects to service a maximum of 40 clients a week. She is requesting a four days a <br />week operation with the hours of 9:00 a.m. to 6:00 p.m. on Tuesdays and Fridays; noon <br /> <br />City Council/November 24, 1998 <br /> Page 9 of 20 <br /> <br /> <br />
