<br />Mr. Ruehle explained Mr. Boike had a purchase agreement on his property previously that fell <br />through. If this deal does not move forward it would be likely Mr. Boike would come forward <br />with a proposal for some type of development. <br /> <br />Mayor Gamec noted the possibility of reverse condemnation if this purchase does not move <br />forward. <br /> <br />Councilmember Jeffrey pointed out that the appraised value in a reverse condemnation situation <br />would be about one million more than what is being presented. <br /> <br />Mr. Ruehle stated one thing that should be noted as a risk is the possibility of property owners to <br />the south and other areas coming to the table if this deal goes through. However, there may not <br />be any RALF funds remaining to do anything so significant with other properties. <br /> <br />Councilmember Strommen stated she had that concern, but one thing about this property is that <br />no matter how it is looked at the entire property is effected, which cannot be said for any of the <br />other parcels. It would be important to highlight that so they are not setting a precedent. <br /> <br />Councilmember Elvig stated he understands they will be taking RALF funds from one project. <br />He asked who will put up the $1.2 million if the City moves forward with this and the funds, <br />which are not guaranteed, are not available. <br /> <br />Metropolitan Councilmember Haas Steffen stated Commissioner Berg has informed her that <br />unless $1.2 million is received from the RALF fund there will be no deal with the County. The <br />County is willing to front all the dollars if there is a guarantee they will receive the $1.2 million. <br />If the City does not agree to officially map the property she has nothing to go forward with. Two <br />things are needed from the City in order to present this to the Metropolitan Council for <br />consideration: 1) formal action on officially mapping the property; 2) a letter stating the City <br />understands there will be a switch with the RALF funds currently in the pipeline for the Bialon <br />property to the Boike property. <br /> <br />Consensus of the Council was to direct staff to include the following on the March 27, 2007 City <br />Council agenda for Council consideration: 1) resolution to officially map the Boike property; 2) <br />a letter outlining the City's understanding of the switch in RALF funding from the Bialon <br />property to the Boike property. <br /> <br />1) Ebony Woods Sketch Plan <br /> <br />Associate Planner Daines stated DPM Investments has submitted a preliminary plat, <br />Comprehensive Plan Amendment and rezoning application to develop 6 twinhomes (3 two-unit <br />buildings) on the lot south of Super Bowl on Ebony Street. The applicant went before the <br />Planning Commission for preliminary plat review last September, 2006. Since that time, the <br />preliminary plat has been before the Council for consideration at a worksession on October 10, <br />2006, and regular Council meetings on November 14,2006, December 28,2006 and January 9, <br />2007. The primary reason for the delay has been the consideration of new elevations for the <br /> <br />City Council Work Session I March 20, 2007 <br />Page 5 of 13 <br />
