Commissioner Jensen suggested an alternative of pushing the garage back 24 feet to align with the <br />front of the house rather than the front of the existing garage. Mr. I-Iamann stated uncertainty if <br />that would work and indicated he would need to measure the property. <br /> <br />Commissioner Wivoda stated opposition to requiring the accessory structure moved behind the <br />residence, as the applicant knows what is possible for his property. <br /> <br />Motion by Commissioner Deemer, to include condition #8: That the accessory structure shall be <br />placed on the same half of the lot the house is located. <br /> <br />Motion failed for lack of a second. <br /> <br />Motion by Commissioner Anderson, seconded by Commissioner Deemer, to recommend the City <br />Council deny the conditional use permit. <br /> <br />Further discussion: Zoning Administrator Frolik stated the Findings of Fact would need to be <br />amended to the negative. Commissioner Deemer disagreed. Commissioner Anderson stated the <br />applicant could build the building within normal standards. He did not object the applicant <br />building the building in the legal size, he only objected to an oversized building. <br /> <br />Motion Carried. Voting Yes: Commissioners Anderson, Deemer, and Jensen. Voting No: <br />Chairperson Bawden and Commissioner Wivoda. Absent: Commissioner LaDue and Terry. <br /> <br />Case #2: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to Maintain <br />More than Two Adult Dogs on a Parcel; Case of Phillip and Frances Teetzel <br /> <br />Zoning Administrator Frolik stated the request is to keep four adult dogs on the property. <br /> <br />Commissioner Jensen inquired regarding the sign posted on the property indicating the dogs can <br />jump. Mr. Teetzel stated a sign is posted on their fence which reads, "We can make it to the <br />fence in three seconds, can you?" He indicated the sign is a joke. He indicated hearing dogs <br />barking in the early hours of morning and stated the barking is not coming from his indoor dogs. <br /> <br />Commissioner Deemer questioned if the dogs are outdoors when the applicant is not at home. <br />Mr. Teetzel stated their house door has a flap for the dogs allowing them to enter and exit as they <br />please. However, he stated they are indoors by 8:00 p.m. and said Mrs. Teetzel is usually home. <br /> <br />Commissioner Jensen asked if the conditional use permit was approved, could the applicant <br />construct a kennel on his property? Mr. Teetzel stated he would not be building a kennel because <br />the dogs are always housed indoors. <br /> <br />Zoning Administrator Frolik stated the applicant is entitled to build a kennel structure on his <br />property regardless of the conditional use permit. <br /> <br />Planning Commission/June 2, 1998 <br /> Page 5 of 10 <br /> <br /> <br />
