COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to Maintain <br />More than Two Adult Dogs on a Parcel; Case of Mark and Doni Heule <br /> <br />Community Development Assistant Walther explained a complaint was received regarding dogs <br />for three different properties in this particular area which initiated the code enforcement action. <br />He indicated the complaint was mainly regarding dogs running loose, however, that was not the <br />issue with the Heule property. <br /> <br />Zoning Administrator Frolik indicated telephone comments received from Mr. Belschner were <br />regarding the Heule property in addition to other properties in the neighborhood. <br /> <br />Ms. Heule stated three neighbors left after the public hearing, however, indicated to her support <br />of the conditional use permit and the privacy fence proposal. She reaffirmed willingness to <br />provide a second privacy fence buffer as a stipulation of the conditional use permit. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to amend the Findings of <br />Fact to the affirmative relating to Mark and Doni Heule's request for a conditional use permit for <br />a private dog kennel for a maximum of 8 dogs. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />LaDue, and Wivoda. Voting No: None. Absent: Commissioner Jensen. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to recommend that City <br />Council adopt Findings of Fact, as amended, relating to Mark and Doni Heule's request for a <br />conditional use permit for a private dog kennel for a maximum of 8 dogs. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />LaDue, and Wivoda. Voting No: None. Absent: Commissioner Jensen. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner LaDue, to amend the proposed <br />conditional use permit by adding Condition #10: That the fencing go almost directly south, but a <br />little bit east, to the right hand comer of the lot (not abutting Lot 4 - the Gihl property). <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Anderson, <br />Terry, and Wivoda. Voting No: None. Absent: Commissioner Jensen. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to recommend that City <br />Council approve the Heule's request to maintain 8 adult dogs at 7262 - 162nd Lane NW, based <br />on the findings of fact, and adopt the conditional use permit as amended. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />LaDue, and Wivoda. Voting No: None.
