City Engineer Jankowski suggested a condition be added that the applicant may use the City <br />property for its haul providing it does not interfere with the construction of County Road 116. <br /> <br />Commissioner Deemer stated concern that at[er the grading was complete a 14 foot cliff would <br />remain on the western portion of the property which would require additional mining and grading. <br /> <br />Mr. LeBlanc stated existing elevations had been provided to staff and the western portion of the <br />property had been a cliff for years and he was trying to get away from the cliff. City Engineer <br />Jankowski stated the proposed project would improve the property. <br /> <br />Motion by Commissioner Terry, seconded by Commissioner Anderson, to amend the Findings of <br />Fact to the affirmative relating to Michael LeBlanc's request for a conditional use permit to grade <br />and export soils and recommend Council adoption of same. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Terry, Anderson, Deemer, <br />LaDue, and Wivoda, Voting No: None. Absent: Commissioner Jensen. <br /> <br />Motion by Commissioner Anderson, seconded by Commissioner Terry, to amend condition #11 <br />of the proposed conditional use permit to state that the west slope grade and the south slope <br />grade be modified and conform with the ordinance of 12%. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Anderson, Terry, Deemer, <br />LaDue, and Wivoda. Voting No: None. Absent: Commissioner Jensen. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Wivoda, to amend condition #12 <br />to state that Michael LeBlanc will be unable to use County Road 116 if his hauling interferes with <br />the County, he will also need to obtain permission from the private property owner between the <br />site and #116, and use of 149th Avenue NW would be prohibited. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Wivoda, Anderson, <br />LaDue, and Terry. Voting No: None. Absent: Commissioner Jensen. <br /> <br />Motion by Commissioner Anderson, seconded by Commissioner Deemer, to recommend Council <br />approve Michael LeBlanc's request for a conditional use permit to grade and export soils based <br />on the findings of fact and adopt the conditional use permit as amended. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Anderson, Deemer, LaDue, <br />Terry, and Wivoda. Voting No: None. Absent: Commissioner Jensen. <br /> <br />Case #5: <br /> <br />Request for a Conditional Use Permit to Grade and Import Soils; Case of <br />North Fork, Inc. <br /> <br />City Engineer Jankowski indicated meeting with Mr. Peck during the recess. He stated they <br />discussed Site A and noted the primary concern was regarding proper drainage of the site.
