to install a personal communication system antenna on the City water tower and approve the <br />request for a conditional use permit and adopt a resolution declaring terms of same. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />Jensen, LaDue, and Wivoda. Voting No: None. Absent: None. <br /> <br />Case//3: Request for a Conditional Use Permit to Grade Soils; Case of Ronald Kabat <br /> <br />City Engineer Jankowski indicated at~er reviewing the application for the mining and grading <br />permit that there appeared to be a location of where the material would be placed may coincide <br />with a drainage and utility easement that followed parallel to the wetland. He stated the pond <br />appeared to be 8.5 feet lower then the house pad which is 60 feet away. The area would be filled <br />2 1/2 feet higher than the elevation of the pond. He indicated the area may be classified as <br />wetland so near to the water table. He suggested if the Planning Commission approved the <br />conditional use permit that they make it contingent on a soil conservation review. <br /> <br />Mr. Kabat stated the height is only 2 feet and the closest material would be placed is 35 feet away. <br />At that elevation it would only be 2 1/2 feet higher then the water table. <br /> <br />City Engineer Jankowski stated the drainage and utility easement encompassed the wetland and <br />said fill should not be placed within that area since it is a storage for storm water. He requested a <br />Cursory Review of the Wetland be obtained from the County. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to recommend that City <br />Council amend the finding of facts relating to Ronald Kabat's request for a conditional use permit <br />to grade soils to the affirmative. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />Jensen, LaDue, and Wivoda. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to recommend that item <br />#17 be removed from the findings as the applicant will not be hauling material away from the <br />property. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />Jensen, LaDue, and Wivoda. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Jensen, to recommend that City <br />Council adopt the amended findings of fact. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Jensen, Anderson, <br />LaDue, Terry, and Wivoda. Voting No: None.
