COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Conditional Use Permit; Case of Anoka Congregation of <br />Jehovah Witnesses <br /> <br />Zoning Administrator Frolik stated staff recommends following the standard B-3 District <br />setbacks, however, the applicant stated it would be difficult to comply with the setbacks from <br />Dolomite Street NW. <br /> <br />Acting Chairperson Deemer inquired if the current small structure on the property would be <br />removed. Mr. Klebs stated the existing structure would be removed with the construction of the <br />proposed utility shed. He said there is a line of trees which screens the property fi.om Dolomite <br />Street NW. He indicated the church building faces Riverdale Avenue NW, however, has a <br />Dolomite Street NW entrance. The address was assigned prior to the principal building being <br />constructed. He stated the church is proposing to construct the utility shed less than five feet <br />closer to Dolomite Street NW than the primary structure. <br /> <br />Commissioner Wivoda inquired if a variance was required to have the building closer to the front <br />property line. Zoning Administrator Frolik stated that structure placement could be approved <br />under the conditional use permit. <br /> <br />Motion by Commissioner Anderson, seconded by Commissioner Wivoda, to recommend that City <br />Council adopt Findings of Fact #1 - 10 as presented and amend Findings of Fact #11 - 19 to the <br />affirmative. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Deemer, Commissioners Anderson, Wivoda <br />and LaDue. Voting No: None. Absent: Chairperson Bawden and Commissioner Jensen. <br /> <br />Motion by Commissioner Anderson, seconded by Commissioner Wivoda, to recommend that City <br />Council approve the request for a conditional use permit from the Anoka Congregation of <br />Jehovah Witnesses, based on the findings of fact, and adopt a resolution declaring the terms as <br />proposed. <br /> <br />Further Discussion: Acting Chairman Deemer requested City Council make the assumption that <br />Riverdale Avenue NW is the main street, not Dolomite. Zoning Administrator Frolik stated the <br />Planning Commission is suggesting imposing the standard 20 foot sideyard property line setback. <br /> <br />Amendment by Commissioner LaDue, seconded by Acting Chairperson Deemer, that the <br />conditional use permit be amended to require a 20 foot setback on the west side. <br /> <br />Amendment Carried. <br />Anderson and Wivoda. <br />Jensen. <br /> <br />Voting Yes: <br />Voting No: <br /> <br /> Acting Chairperson Deemer, Commissioners LaDue, <br />None.
