Case ~4: <br /> <br />Request for a Conditional Use Permit to Construct an Accessory Structure <br />Prior to a Principal Building and to Exceed the Total Accessory Structure <br />Space and the Maximum Single Accessory Structure Size Restrictions on a <br />Lot; Case of Jim Reichert <br /> <br />Zoning Administrator Frolik stated the applicant is requesting a conditional use permit to have an <br />accessory building on a lot prior to a principal building or dwelling, exceed the total accessory <br />structure/garage space allowed, and the maximum single accessory structure size restrictions on a <br />vacant parcel he owns south of his homestead at 16491 Uranium Street NW. Mr. Reichert is <br />proposing to construct a 1,920 square foot garage on a 1.04 acre vacant parcel he owns south of <br />his homestead. He is proposing to store his commercial vehicles and equipment in this new <br />garage. The garage exceeds the total allowable garage space allowed on the property by 256 <br />square feet and the maximum building size by 1,120 square feet. <br /> <br />Zoning Administrator Frolik indicated Staff is concerned that by granting the conditional use <br />permit without a principal building or dwelling on the property, that it could be sold at any time <br />and could prove to have an illegal use for future business. She suggested granting the conditional <br />use permit may proliferate a code enforcement problem. She stated there are no other vacant lots <br />in that area. Staff recommends denial of the conditional use permit for Mr. Reichert. <br /> <br />Zoning Administrator Frolik stated according to the building official it would be costly to correct <br />the soils on this lot to facilitate a dwelling and septic system. If the lot split was reversed and <br />parcel replatted a variance and a conditional use permit would still be required to exceed the size <br />restrictions and build closer to road. <br /> <br />Mr. Reichert stated he was not planning to increase the size of his current business. The lot is <br />unbuildable unless it has soil corrections. He stated the lot is wooded and the building would not <br />be noticeable, nor would it disturb the wetlands. <br /> <br />Acting Chairperson Deemer indicated driving through the area and was unable to find another lot <br />with an accessory structure or detached building. He commended Mr. Reichert for keeping his <br />business equipment concealed, however, having employees go to and from his property was <br />against City Code. He stated he would be opposing the request for the conditional use permit. <br /> <br />Motion by Commissioner LaDue, seconded by Commissioner Wivoda, to accept Findings of Fact <br />#1 - 18 as presented. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Deemer, Commissioners LaDue, Wivoda and <br />Anderson. Voting No: None. Absent: Chairperson Bawden and Commissioner Jensen. <br /> <br />Motion by Acting Chairperson Deemer, seconded by Commissioner Anderson, to amend Findings <br />of Fact #19 - 25 in a negative fashion. <br /> <br />Motion Carried. Voting Yes: Acting Chairperson Deemer, Commissioners Anderson, LaDue and <br />Wivoda. Voting No: None.
