Absent: Chairperson Bawden. <br /> <br />Further Discussion: Commissioner Anderson stated reference was made to the legal opinion of <br />Kennedy and Graven and, he believes, an argument is being made that the City has until <br />December 31, 1998 to bring zoning into conformance with the existing Comprehensive Plan. <br />Mr. Anderson then submitted that the current zoning map still has some erroneous zoning on it. <br />He suggested that if the City was going to go forward with Arcon's request, it also ought to clear, <br />up all the erroneously classified areas. Mr. Anderson noted he believed Chapter 9 allows the <br />Planning Commission to ask for rezoning, and he suggested the Planning Commission attach <br />such a request to this one and call for a new public hearing to address all changes. <br /> <br />Second amendment by Commissioner Anderson and seconded by Commissioner Jensen to direct <br />the City Attorney to give a legal opinion regarding the Planning Commission's ability to request <br />that all erroneous zoning classifications be brought into conformance with the current <br />Comprehensive Plan along with Arcon's request. <br /> <br />Second amendment carded. Absent: Chairperson Bawden. <br /> <br />Commissioner Jensen noted her confusion as to what is currently in the ordinance. <br /> <br />Ms. Frolik explained that the changes suggested by the Chapter 9 Review Subcommittee (which <br />included Commissioner Jensen) have not been officially approved and are not to be considered at <br />this time. She did, however, explain that the subcommittee is recommending the deletion of all <br />references to R-1 Urban and R-1 Residential classifications to eliminate the need for rezoning <br />when an amendment to the Municipal Urban Service Area (MUSA) occurs. <br /> <br />Case #3: Consideration of Site Plan Review Section of Ramsey City Code <br /> <br />Chairperson Deemer explained that the Site Plan Review Process section was pulled from the <br />Chapter 9 Review Subcommittee recommendations for immediate review and consideration. <br /> <br />Commissioner Jensen inquired as to why reference to signs was deleted. <br /> <br />Zoning Administrator Frolik explained that signs are addressed in a different section of the City <br />Code, and it was decided to avoid any confusion by keeping the requirements all in the same <br />section. <br /> <br />Commissioner Jensen asked whether the City Code requires irdgation, and Community <br />Development Director Sherman replied that it is not required. <br /> <br />Planning Commission/December 3, 1998 <br /> Page 5 of 9 <br /> <br /> <br />
