15. Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the • <br />structure; (b) no more than 16 building permits in the 2 nd and 3r Additions will be issued <br />until a second paved ingress /egress is provided to the Plat (c) a Certificate of Survey, <br />including that survey information required by the CITY has been supplied to the City <br />Building Official; (d) all the financial guarantees required by the CITY have been satisfied; <br />and (e) this Development Agreement has been signed and received by the CITY. All <br />foundation approvals will require a certificate of elevation verifying that the actual elevation <br />is in compliance with the approved grading and drainage plan. <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) <br />both the sanitary sewer and water utilities are in place, fully operational, and accepted by the <br />CITY; (c) for lots that have a slope of less than 2 %, a certificate of grading, prepared by a <br />licensed (State of Minnesota), professional land surveyor, must be provided to the City <br />documenting that the flattest grade on this lot is 1% or greater will require certificates of <br />grading; and (d) boulevard sod and landscape trees, or escrow for same, have been provided <br />(see Paragraph 20 below). <br />SECTION IV <br />PARK DEDICATION <br />16. Park Dedication. The Brookfield Plat is located in the Trott Brook Recreation District. • <br />Park dedication requirements shall be satisfied by a cash payment of Two Thousand Four <br />Hundred Seventy Five Dollars and no cents ($2,475.00) per lot. The Plat is creating 45 lots, <br />therefore the cash payment due on the Plat is One Hundred Eleven Thousand Three Hundred <br />Seventy -Five Dollars and no cents ($111,375.00) (45 lots x $2,475/lot). This payment shall <br />be made to the City prior to the release of the Final Plat for recording. <br />SECTION V <br />TRANSPORTATION AND LANDSCAPING <br />17. Trail Development and Fees. The 2007 Trail Development Fee is Six Hundred Dollars and <br />'no cents ($600.00) per unit. Therefore, a payment in the amount of Tiventy -Seven Thousand <br />Dollars and no cents ($27,000.00) (45 lots x $600.00/10t) shall be paid to the CITY prior to <br />releasing the Plat for recording. <br />18. Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br />CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br />prescribed by the CITE.', not to exceed 5 %. Sidewalk construction will occur alongl70' Trail <br />N.W. and Marble Street NW.
