<br />will be coordinated with the construction of the 2nd Addition. Staff is recommending that Lot 6, <br />Block 4 be included with a future phase of Brookfield rather than the 3rd Addition, to avoid <br />complications with grading and drainage on the site. Mr. Trudgeon advised staff recommends <br />approval of the final plat. <br /> <br />Mayor Gamec asked about the conservation easement on this property. <br /> <br />Community Development Director Trudgeon indicated there is a conservation and trail easement <br />on the property. <br /> <br />Public Works Director Olson stated he recalls that the trail was staked. They had wanted to get <br />the trail done as part of the first addition. It has not been constructed yet, but everyone that <br />moves in there knows the stakes represent a trail, and they hope to get that accomplished as soon <br />as possible. <br /> <br />Councilmember Strommen indicated something should be done to mark the boundary of the <br />conservation easement. She asked whether the conservation easement has been recorded and <br />mapped out. <br /> <br />Community Development Director Trudgeon replied yes. His understanding is that the <br />conservation easement is a separately recorded document. An exhibit could be included in the <br />weekly update to show it is in existence and the location. <br /> <br />Councilmember Strommen requested that the conservation easement be marked on the ground <br />before construction begins. <br /> <br />Councilmember Elvig clarified the conservation easement was not a "taking"; it was purchased <br />with conservation dollars. He noted there have been disputes about conservation buffers and <br />things of that nature recently. He asked whether the property density took into account the <br />overall property including the easement. <br /> <br />Community Development Director Trudgeon replied the developer was able to use the overall <br />area as part of the density. The easement did not restrict density. <br /> <br />Councilmember Elvig asked if the developer found any negative values on this property due to <br />the conservation easement. <br /> <br />Mr. John Peterson, Oakwood Land Development, stated it is a very serious negative for people <br />who are living and buying homes adjacent to it and directly behind it. The idea of a trail along <br />Trott Brook is an old idea in this City. They knew that when they bought the land, and have no <br />argument with the City's commitment to build that trail. The City purchased the easement with <br />State money for a fair price and Oakwood is under contract with the contractor to put the entire <br />trail in, which will run the entire length of the property they own by the end of the summer. The <br />tradeoff from the City's perspective is that there probably are none of them in this room that <br />would want a public trail right off their deck; they would rather have Trott Brook all by itself. <br />The people deciding whether to buy on the trail are the ones they hear the most from.
