Mayor Gamec requested that the City Engineer study the issue and report back to the Council.
The issue is what is going to happen along Highway #10 and how long are they going to wait.

Councilmember Strommen requested that staff get more information from the Department of
Health and the MPCA so they could weigh the public health issue over the convenience issue
before the two parties negotiate any of the issues.

Councilmember Zimmerman stated that they need to take into consideration the rights of the
property owners at the time they applied.

Mayor Gamec stated that he thought the City was requiring, as part of the rewrite of Chapter 9 of
the City Code, that sewer and water has to be extended to the property line.

Community Development Director Frolik replied that the developers of Sunfish Commons were
under that requirement, but it was waived by the City Council to come in conjunction with the
frontage road.

City Attorney Goodrich noted that he disagrees with the interpretation of the development
agreement as stated by the manager of Sunfish Commons. He explained that the City would
have a very compelling argument because in the development agreement it states that the
developer shall cause the watermain to be extended to the property line. If things change and the
City does not require the frontage road to be constructed the developer would still be required to
extend the services to the property line.

Motion by Councilmember Kurak, seconded by Councilmember Strommen, to direct staff to
consider the Council discussion pertaining to the extension of sewer and water to Oak Terrace
Estates regarding timing and health issues.

Further discussion: Councilmember Kurak stated that public safety, health and welfare should be
their top priority.

Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Strommen, Cook,
Elvig, Pearson, and Zimmerman. Voting No: None.

Case #2: Lions Picnic/Application for a One-Day, 3.2 Malt Liquor License

Mayor Gamec stated that the Ramsey Lions are again applying for a one-day, 3.2 percent malt
liquor license for the Community Picnic that is scheduled for Saturday, June 7, 2003, at Central
Park. The Lions have provided all of the necessary documents required for issuance of this type
of license. Under City Code, it is a permissible activity to grant a 3.2 percent malt liquor license
to the Ramsey Lions Club for this event. As has been done in the past, City staff requested that
the Council waive the license fee. The Lions Club is non-profit and generously gives to the
community.

City Council/May 13, 2003
