City Engineer Jankowski replied yes. <br /> <br />Councilmember Zimmerman felt that each individual property owner should take care of their <br />own storm water and in this case it is feasible for the trailer park property owners to dig their <br />own pond. <br /> <br />City Administrator Norman stated that they are going through the feasibility study process, but a <br />greater question that needs to be asked is what they are doing. Sunfish Commons was <br />constructed before the Highway #10 study was completed and now they have an alignment study <br />indicating that perhaps development should not proceed in the area. He questioned if a property <br />owner petitions for a project is there an entitlement to have sewer and water because it can <br />encourage development of the area. <br /> <br />Councilmember Cook questioned why would the City want to pay for improvements or <br />encourage a developer to pay for improvements when ultimately they don't want to see the land <br />developed. <br /> <br />City Administrator Norman inquired if legally the City is required to provide sewer and water. <br /> <br />Councilmember Kurak stated that she thought there was a safety issue of well water and the <br />pumping of septic systems and if the property owner wants to pay for the improvements <br />themselves how can they stop them from doing so. <br /> <br />City Attorney Goodrich explained that the Department of Health could force the City to extend <br />City services if there are health concerns, but he was not prepared to discuss the necessity of <br />extending sewer and water to the trailer park property. <br /> <br />Councilmember Kurak inquired as to how the City determines if there are safety concerns. <br /> <br />City Attorney Goodrich replied that that would be a Department of Health and Engineering issue. <br /> <br />City Engineer Jankowski stated that in order to determine whether there is a health problem on <br />the property he would get help from Minnesota Department of Health. What has been indicated <br />to him is that the systems are not up to standard and they probably do pose a health hazard. <br /> <br />Councilmember Kurak inquired if the issue is what is the City going to do to address the health <br />hazard issues or to have the property owners negotiate regarding the drainage issues. <br /> <br />City Attorney Goodrich replied that those are both issues before the Council. <br /> <br />Councilmember Kurak noted that the trailers are rental units and residents don't have much say <br />as to what occurs on the property. <br /> <br />City Council/May 13, 2003 <br /> Page 9 of 29 <br /> <br /> <br />
