Councilmember Elvig inquired if there was any concern with the soil quality. <br /> <br />City Engineer Jankowski explained that the soil used to create the berm was taken from the <br />bottom of the pond, so there were no concerns with the quality of the soil <br /> <br />Councihnember Cook suggested that they proceed with the settlement agreement and if the <br />property owners don't respond, then the City should move forward with legal action. <br /> <br />Councilmember Strommen inquired if it was necessary for other property owners to agree to the <br />settlement agreement or is the City forcing other property owners to have equipment pass on their <br />property. <br /> <br />City Engineer Jankowski replied that he would recommend requiring that a construction fence be <br />placed on the property lines and require that all equipment stay within their property limits. <br /> <br />City Attorney Goodrich stated that the settlement agreement should include language that states <br />that trespassing is prohibited on other people's property. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Cook, to direct staff to enter <br />into an agreement with the property owners as an alternative to pursuing legal action, as amended <br />by the City Council. <br /> <br />Further discussion: Councilmember Kurak stated that if the property owners have not signed the <br />permit by June 1 st, then they have not complied with the agreement and the City should proceed <br />with legal action. Mayor Gamec requested that the issue be placed as an agenda item for the <br />June 10, 2003 City Council meeting, to update the Council as to the status of the agreement. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Cook, Elvig, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #12: Report from Public Works Committee <br /> <br />1) Consider Changes to Municipal State Aid System <br />The purpose of this case was to solicit from the Committee a recommendation to modify the <br />City's MSAS system such that major streets within the Town Center would become eligible to be <br />constructed with MSAS monies. Action was taken by the City Council at the April 22, 2003 City <br />Council meeting. <br /> <br />2) Adopt City of Ramsey Street Sweeping Policy <br />The Public Works Committee recommended that the City Council adopt the Street Sweeping <br />Policy. <br /> <br />City Council/May 13, 2003 <br /> Page 19 of 29 <br /> <br /> <br />
