City Administrator Norman replied the Council Contingency fund. <br />Councilmember Kurak questioned the justification for getting Ramsey Town Center, LLC <br />involved. Councilmember Elvig replied that all of the highway infrastructure is going to the <br />Town Center and the City needs to make it clear that they are not always able to cover 50 percent <br />of the cost. <br /> <br />Motion can'ied. Voting No: None. <br /> <br />Case #15: <br /> <br />Consider Adoption of Resolution Approving Settlement of County Road #116 <br />Condemnation Action <br /> <br />Councilmember Kurak abstained from the discussion. <br /> <br />City Attorney Goodrich stated that at a closed Attorney/Client meeting, the City Council <br />considered a settlement with Thomas R. Kurak and Pattiann Kurak concerning the acquisition of <br />certain right-of-way for the construction of County Road #116. This action has been appealed to <br />the District Court. Based upon the mediation held on May 2, 2003, and the advice of the City's <br />counsel on this matter, John M. LeFevre, Jr., staff recommended adoption of the resolution. <br /> <br />Motion by Councilmember Strommen, seconded by Councilmember Elvig, to adopt Resolution <br />#03-05-121 approving settlement of the pending Anoka County District Court condemnation <br />action docketed as City of Ramsey v. Thomas R. Kurak and Pattiann Kurak v. Richard Knutson, <br />Inc. and Anoka County, Case No. C5-98-3541. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Strommen, Elvig, Cook, <br />Pearson, Zimmerman. Voting No: None.
