I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #03-02- A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROM JANIS DAY FOR A HOME OCCUPATION PERMIT TO ESTABLISH AN IN HOME HAIR SALON ON THE PROPERTY LOCATED AT 16321 FERRET STREET. WHEREAS, the City of Ramsey received an appliCatiOn from Janis Day for a home occupation permit to operate a one-chair hair salon witl/in the dwelling on the property generally known as 16321 Ferret St NW and legally described as follows: Lot 17, Block 4, Oakridge Estates, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of'fact relating to the request are determined to be as follows: o o That on January 2, 2003, Janis Day, hereinafter referred to as "Applicant", properly applied for a home occupation permit to establish and operate a hair salon in her home. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on February 6, 2003, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by referenCe. That the Subject Property is zoned R-1 Single Family Residential. 4. That the Subject Property is apProximately 2.5 acres in size. 5. That hair salons are not a permitted use in the R-1 single Family Residential District. That the Applicant has stated that the home occupation will be conducted within the- private dwelling on the property, the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling, and the operation will not: include any employment of persons not residing in the private dwelling in the performance of the home occupation. That the Applicant's principal dwelling is serviced by an on-Site septic system, therefore Minnesota Pollution Control Agency (MPCA) must approve the in home hair salon due to the chemicals that will be discharged into ~he septic system, 8. The Applicant has filled out and submitted the required forms to MPCA. -107-
