Preliminary Plat: .The Village of Sunfish Lake <br />January 31, 2003, R.evised February 21, 2003 <br />Page 6 of 7 <br />15. Shoreland District: Portions of the proposed parcel to be developed are contained in the <br /> Shoreland Overlay District. Sunfish Lake is classified as a Recreational Development Lake <br /> and land within 1000 feet of the Ordinary High Water 'mark need to comply with the <br /> shoreland regulations. These regUlations include a minimum of 15,000 square feet for each <br /> lot and a width of 75 feet at the building line. Under the adopted Shoreland Ordinances, a <br /> PUD that alters the minimum dimensional standards can be considered·, but first need to be <br /> approved by the Minnesota Department of Natural Resources before the City approves the <br /> development. - <br /> <br /> I <br /> I <br />I <br />'1 <br />I <br /> <br />-220- <br /> <br />Tom Hovey of the DNR. has reviewed your plan' and has indicated that the plan is 'generally <br />acceptable. The DNR has indicated that the density of units contained within the. Shoreland <br />Over[aY District is a little more than they would typically like to see, but given the amount of <br />open space preserved as part of the development, and the fact that there will be less <br />stormwater runoff into Sunfish Lake than currently occurs, the DNR finds the plan <br />acceptable. <br /> <br />16. Environmental Issues: As this development is Occurring within the Shoreland Overlay <br /> District, City Code requires that certain environmental review occurs and criteria is met. The <br /> majority of the review criteria regards grading and filling within the Shoreland area. This <br /> information is reviewed as part of the Lower Rum River Water Management permit process. <br /> The other main component of the required environmental review deals with the protection of <br /> trees. The City will, as in previous developments,use best management practices during <br /> grading around trees. Also, you have submitted a tree preservation plan that complies with <br /> the required review regarding tree removal.. <br /> <br />t7. Sidewalks. In accordance with City Code, sidewalks are required on one side of all public non <br /> <br /> · cul-de-sac streets. If the cottages are served by private streets, the submitted.plans conform to <br /> the sidewalk ordinance. <br /> <br />18. Trail Development: At the City Council workshop on January 21, 2003, 'the C!ty Council <br /> indicated that they would like to have. the'trail along the eastern edge of the plat removed. The <br /> Planning Commission, at their February 6, 2003 meeting, recommended that' the trail on the <br /> eastern portion of the development be removed. The Planning Commission also recommended <br /> that the southern trail be removed from the plat. The Park and'Recreation Commission reviewed <br /> the plat on February 13, 2003. The Commission felt strongly that the ;rail on the south edge of <br /> the plat be constructed as originally proposed, and in addition, that it be extended southwesterly <br /> (in the sedimentation pond area) to connect to 1.45th' Lane adjacent to Sunwood Drive. . The <br /> Commission acknowledged that several residents Spoke against the trail located, on the southern <br /> edge, but noted'that the trail will be .of value to a large number of existing residents', for <br /> recreation.'The City Council will be making the final determination on the south trail. ' <br /> <br />19. Park Dedication/Open Space: The City has. the option for cash, [and, or a combination of <br /> the two. The 2003 rate for park dedication is $1,800 per unit; again, tke rate in' effect at the. <br /> time of final plat approval will be required. The PUD ordinance requires that the <br /> development have either 20% public open space and/or 50%. private and open space. The. <br /> Park Commission, at their January 8, 2003 meeting did not recommend the provision of <br /> public open space within tlie development and would be inclined to collect park dedication <br /> <br /> I <br /> I <br />I <br />I <br />i <br />I <br />I <br />.I <br />I <br /> <br />I <br /> <br /> <br />
