! <br />I <br /> <br />PEDESTRIAN TRAIL <br />EASEMENT AGREEMENT <br /> <br /> THIS INDENTURE, Made this ~ day of September, 2002, between CHARLES <br />M. PRATLEY and MARLENE' C. PRATLEY, husband and wife, herein referred to as the <br />"Landowners", and the CITY OF RAMSEY, a municipal corporation organized under the laws <br />of the State of Minnesota, hereinafter referred to as the "City", <br /> <br />WITNESSETH: <br /> <br /> That the said Landowners in consideration of the sum of One Dollar and other good and <br />valuable consideration to them in hand paid by the City, the receipt and sufficiency of which is~ <br />hereby acknowledged, does hereby grant and convey unto the said City, its successors and <br />assigns, forever, a permanent easement and right-of-way for a trail over, under and across the <br />following described property: <br /> <br /> The northerly 15 feet of Lot 1, Block 3, GORHAM'S SANDY ACRES <br /> ESTATES, Anoka County, Minnesota. <br /> <br />Together with a temporary easement for construction purposes over the southerly <br />10 feet of the.northerly 25 feet of Lot 1, Block 3, GORHAM'S SANDY ACRES <br />ESTATES, Anoka County, Minnesota. Said temporary easement shall expire on <br />December 31, 2002. ' <br /> <br />The permanent easement shall be for use as a pedestrian and non-motorized recreatibnal trail and <br />shall include such activities as walking, running, biking, skiing, in-line skating, roller skating,. <br />skateboarding, the walking of household pets and other forms of similar non-motorized <br />pedestrian use. In addition, the easement may be used by public emergency motorized' vehicles <br />and public maintenance motorized vehicles. The easement.shall' not be used .by other motorized <br />vehicles, or by all terrain vehicles, or by snowmobiles, and the easement shall: not be used for <br />horseback riding. No structures, obstructions or fences shall be allowed in the easement area <br />unless written approval, is granted by the-City. <br /> <br />EXEMPT FROM STATE DEED TAX PURSUANT TO MINN.
