CASE #: .' 3 . <br /> REQUEST FOR FINAL PLAT REVIEW OF RIVENWlCK 3RD ADDITION <br /> CASE OF TURTLE MOON INC. <br /> BY: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Turtle Moon Inc. has applied for final plat approval of a townhOme development named Rivenwick 3 <br />Addition. The property is generally located south of Riverdale' Drive and north of the existing Rivenwick <br />urban residential development. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c). <br />d) <br />e)' <br /> <br />Site location map <br />Final Plat <br />City Council meeting minutes dated January 14, 2003 <br />City StaffReview Letter dated March 7, 2003 <br />Proposed resolution for final plat approval <br />Proposed Development Agreement <br /> <br />Notification: <br /> <br />State statute does not require notification of applications for final plat approval, staff attempted to notify <br />property owners within 700 feet of the subject property during preliminary plat review. <br /> <br />Observations: <br /> <br />The preliminary plat approved by the City Council on January 14, 2003 consists of 112 townhouse units. <br />The final plat substantially conforms to the approved preliminary plat. City Engineer Steve Jankowski <br />has reviewed the Final Grading Plans, Construction Plans and Specifications. The City Staff Review <br />Letter dated March 7, 2003 outlines the required modifications and corrections that need to be made to <br />the plans. <br /> <br />The City Council introduced a rezoning ordinance on janUary 14, 2003 to rezone a portion of the <br />property from B-1 Business to R,2 MediuTM Density Residential. A case has been prepared for Council <br />review to adopt the rezoning ordinance on'March 11, 2003.' <br /> <br />Park dedication will consist of a cash payment. However, the Park and Recreation Commission is <br />recommending that half of the park dedication fees go towards park improvements for Riverdale Park, <br />located adjacent to the plat, and existing parkland located along the Mississippi River. Staff, the Park and <br />Recreation Commission, and the developer may work on an amendment to the Development Agreement. <br />to incorporate appropriate park improvements to the subject parks. In the event all parities involved agree <br />to park improvements, an amendment to the Development Agreement will be brought back to the City <br />Council. <br /> <br />The final plat encumbers all common opens spaces and drainage ponds with drainage and utility <br />easements. <br /> <br />Council's approval of the preliminary plat was granted with certain contingencies that have been <br />addressed as follows: 1) An existing fence encroaches onto the developer's property. In order for <br />Rivenwick 3'd Addition to achieve clear title, the title company is requiring the fence be' removed from <br />Mr. Shulte's property. Mr. Shulte, the. developer; and Mr. Frankfurth, fence owner, agreed that Mr. <br />Shulte will have land surveyors mark the property line and Mr. Frankfurth will remove.the encroaching <br />fence sometime this spring. 2) A part of the motion stated that no Certificate of Occupancies are to be <br /> <br />-111- <br /> <br /> <br />
