The developer is requesting that building permits <br />and certificate of occupancies be permitted for the first five townhouse structures (Lots 10, 9, 8, 7, Block <br />2 and Lot 5, Block 1) until the intersection upgrade of Highway #10 and Ramsey Blvd. is operational. <br />Fire Chief Dean Kapler is supportive of the developer's request from a public safety standpoint. <br /> <br />ReCommendation: <br /> <br />Staff recommends final plat approved contingent upon compliance with City Staff Review Letter dated <br />March 7, 2003 and the Developer and the City entering into a Development Agreement. <br /> <br />It should be noted Ghat the Development Agreement is drafted to restrict building permits and certificate <br />of occupancies to the first five structures. If the City Council is so inclined to change the terms, the <br />Development Agreement should include such revised language. <br /> <br />Council Action: /_ <br />Motion to adopt Resolution #0%0%10 to approve the final plat of Rivenwick 3ra Addition contingent <br />upon compliance with City Staff review letter dated March 7, 2003, a portion of the property being <br />rezoned from B-1 Business to R-2 Medium Density Residential, and the Developer entering into a <br />Development Agreement with the City. <br /> <br />-or- <br /> <br />Motion to deny the final plat ofRivenwick 3rd Addition. <br /> <br />CC: 3/11/03 <br /> <br />Review Checklist: <br />Community Development D/rector <br />Principal Planner <br />City Administrator <br />City Engineer(s) <br /> <br /> <br />
