-170- <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />SECTION I <br />IMPROVEMENTS <br /> <br />Access to Lots. Access to the lots shall be from the existing I53~d Ave fight-of-way. <br /> <br />Drainage and Utility Easements. The standard 10-foot (5 feet on common property <br />lines) drainage and utility easements shall be dedicated along the perimeter of each of the <br />two lots. All areas where wetlands are located shall be dedicated as drainage and utility <br />easements on those lots that. are less than 10 acres in size. <br /> <br /> SECTION II <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet <br />of the structure; (b) a Certificate of Survey, including that survey information required by <br />the CITY, has been supplied to the City Building Official upon his/her request; and (c) <br />all the financial guarantees required by the CITY have been satisfied. No occupancy <br />permit for any lot in the Plat shall be-issued until: (a) all utilities are in place, operational <br />and accepted by the CITY; and (b) landscape trees, or escrow for same, has been <br />provided. <br /> <br />4 <br /> <br /> SECTION III <br />PARIS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Marble Park District. Lot 2 is the existing <br />homestead and is exempt from this fee. The DEVELOPER shall satisfy the park <br />dedication requirement for the Plat with a cash payment of One Thousand Seven <br />Hundred dollars and no cents ($.1,700) (1 lots x $1700 per lot). <br /> <br />Trail Development Fee. The City has enacted a trail development fee in the amount of <br />Four Hundred Dollars and no cents ($400.00) per lot. Lot 2 is the existing homestead <br />and is exempt from this fee. Therefore, a payment for one new lot in the amount of Four <br />Hundred Dollars and no cents ($400.00) shall be paid to the City prior to releasing the <br />Final Plat for recording. <br /> <br /> <br />
