CASE # <br /> <br /> REQUEST FOR AN INTERIM USE PERMIT TO ALLOW <br />OUTDOOR STORAGE OF COMMERCIAL VEHICLES AND EQUIPMENT ON A <br />RESIDENTIALLY ZONED PARCEL; <br /> CASE OF GERALD BAUER <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On February 25, 2003 the City Council reviewed a request, from Gerald Bauer, fee title owner, and <br />Able Paving, leasee, to store commercial vehicles and equipment on the siteofthe Ramsey Shooting <br />Center, 16130 Variolite Street N.W. The interim use permit is required because the-underlying <br />zoning of the subject property is R-1 Residential; for which industrial uses are not permitted. The <br />shooting center that currently exists on the site is considered a lawful non-conforming use of the <br />property (aka grandfathered). The following items are enclosed for your review: <br /> <br />a) Site location map <br />b) Pictures of the Subject Property <br />c) Planning Commission meeting minutes dated February'.6, 2003 <br />d) Email from Sharon Stuckmayer dated February 6, 2003 <br />e) Email from Sue Foell dated February 12, 2003 <br />f) Proposed Findings of Fact <br />g) Proposed Interim Use Permit <br /> <br />Notification: <br /> <br />In accordance with State statute, Staff notified property owners within 350 feet of the subject <br />property of the public heating. <br /> <br />Observations: <br /> <br />Gerald Bauer owns the Ramsey Shooting Center located 16130 Variolite Street N.W. The total area <br />of the site is 120 acres. For the past two years, Mr. Bauer has been leasing a portion of his property <br />to Able Paving for the purpose storing their vehicles and equipment during off-business hours. The <br />use includes some routine maintenance of vehicles and equipment and some storage of excess clean <br />fill. The vehicles are parked outdoors and maintenance functions are conducted witlfin an accessory <br />building on the property. Able Paving currently has' about 160 cubic yards of'clean fill stockpiled on <br />the site. .. <br /> <br />During the winter, Staffwas notified that Able Paving was basing their operation at the Site. Mr. <br />Bauer was advised that because the property is zoned'residential, the use either had to cease or he <br />could apply for an interim use permit to continue the use for a limited amount of time. Mr. Bauer <br />applied for the interim use permit. <br /> <br />-175- <br /> <br /> <br />
