-176- The Planning Commission conducted a public hearing on February 6 and several residents were opposed to the request based on the potential noise nuisance and interruption to flow of traffic on Variolite caused by slow moving dump trucks. The Planning Commission recommended denial of Mr. Bauer's request. The City Council met on February 25 to review the request. At that time, City Staff Was directed to draft findings of fact to support approval of the request. Council's direction was based on the fact. that Able Paving has been leasing the site, virtually unnoticed, for 2 years. The size of the operation is minimal, the size of the property is significant, the current shooting center generates more traffic and noise than the paving operation, and the access is on a Municipal State Aid road. Per Staff' s direction, revised findings of fact haVe been drafted, City'Staff also drafted a proposed permit which restricts the number of vehicles and equipment, hours of operation, stockpiled materials, maintenance activities, proper parking and access surfaces, and financial sureties. Recommendation: In accordance with the City Council's direction, City Staff is recommending adoption of findings of fact and approval of the request. . Council Action: Motion to adopt Resolution #03-03- adopting Findings of Fact from Gerald Bauer for an Interim Use Permit. relating to a request -and, Motion to approve Mr. Bauer's request for an Interim Use Permit 16130 Variolite Street N.W., based on the findings of fact, and adopt Resolution #03-03- . declaring terms of same.
