-200- <br /> <br />In the opinion of the City Attorney, there is not enough evidence on file to justify scheduling a <br />public hearing to consider revocation of the conditional use permit. However, the City Council <br />could schedule a public hearing for the purpose of amending the terms of the conditional use <br />permit. <br /> <br />Enclosed for your information is a copy of the November 26, 2002, City Council meeting <br />minutes. All other enclosures pertaining to this case are included in the November 26, 2002 <br />Council case that was distributed to all councilmembers with the February 28 Weekly Update <br />packet. <br /> <br />Recommendations: <br /> <br />City Staff is recommending the following course of action: <br /> <br />When plant operations resume in the Spring, monitor odors on a daily basis for a <br />probationary period of time to determine if the stricter additive standards are <br />reducing odor problems. Last November, Public Works Director Kapler noted the <br />proximity of Public Works to the asphalt plant and offered assistance in <br />monitoring odors. Monitoring odors should reflect whether or not the stricter <br />additive standards are having a positive affect. <br />Instruct Commercial Asphalt to raise the height of the smokestack. This should <br />also have the affect of reducing odors. <br />City Staff to make quarterly reports to City Council on the status of plant <br />operations. <br /> <br />Council Action: <br /> <br />Motion by <br /> <br />and seconded by <br /> <br />to direct Commercial Asphalt to: <br /> <br />step up enforcement of additive standards; and/or <br />increase the height of the smokestack; and <br /> <br />direct City Staff to make quarterly status reports to City Council regarding plant operations. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br /> <br />CC: 03/I1/03 <br /> <br /> <br />
