Voting No: None. <br /> <br />Case #6: <br /> <br />Request for Final Plat Approval of Villas of Meadow Pointe Tonwhomes: <br />Case of Allstate Development, LLC <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to' table action on <br />final plat approval of Villas of Meadow Pointe Townhomes until December 10, 2002. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, __Anderson, <br />and Zimmerman. Voting NO: None. <br /> <br />Councilmember Hendriksen stated that he had thought they were supposed to have the <br />Rivenwick development on the agenda tonight. <br /> <br />Principal Planner Trudgeon replied that Staff received, a letter from the developer today waiving <br />the 60-day rule. <br /> <br />Mayor Gamec recessed the regular meeting of the City CounCil at 8:30 p.m. <br /> <br />Mayor Gamec called the regular meeting of the City Council back to order at 8:38 p.m. <br /> <br />Case #7: Case of <br /> <br />Status of Conditional Use Permit for Asphalt Mix Plant: <br />Commercial Asphalt <br /> <br />Cormnunity Development Director Frolik stated that at citizen input at City Council meetings on <br />October 22 and November 12, City Council received a complaint' on each date from a resident <br />regarding bad odors emanating from the commercial Asphalt plant located at 14100 Basalt Street <br />NW. Staff was directed to research the historY of the conditional use permit, and related <br />complaints, and what enforcement capabilities the. City has when od'ors may not exceed PCA <br />pollution limits but may be subject to local nuisance laws. in t988, the current Owner applied to <br />the City for a conditional use permit to operate the asphalt Plant. As a pa~ of the conditional use <br />permit process, the Planning Commission conducted a public hearing. At the hearing, two <br />comments were submitted regarding the Concern with the Current oWners then existing plant in <br />Anoka, and the potential for odor problems at the Ramsey site. The permit was issued and it' was. <br />in effect until 1995. In 1995, the City renewed the conditional· use permit for the' asphalt plant: <br />Again, the Planning Commission conducted a public hearing and there was one comment. <br />submitted in opposition to renewing the permit.
