Morgan County, - S.E.2d -, 2006 WL <br />3438182 (Ga.) <br /> <br />GEORGLA. (11/02/06)-EarthResources, LLC, purchased land in Morgan Coun- <br />ty. Although the property was zoned agricultural, EarthResources sought to cre- <br />ate a landfill. EarthResources sought a verification of zoning compliance, claim- <br />ing that a landfill was a "public utility," and, as such, it was an allowable use <br />under the zoning ordinance then in effect. <br />After a hearing, the zoning commission voted to deny the verification. <br />EarthResources sued the commission and the county in court, arguing that it was <br />denied due process and claiming other procedural violations. The county asked <br />the court for judgment without a trial. <br />The court found in favor of the county, and Ear-chResources appealed. <br /> <br />Decision: Affirmed. <br /> <br />EartbResources' claim resred on the proposed landfill being defined as a pub- <br />lic utility. The ordinance defined public utilities as: "Entities engaged in regularly <br />supplying the public vi!ith some co=odity or service which [was] of public con- <br />sequence or need, regulated and conuolled by a state or federal regulatory com- <br />mission and which [had] the power of eminent domain."
