<br />Recommendation: <br /> <br />Staff recommends siting the tower in the alternate location, thus eliminating the need for the <br />variance. If the Planning Commission determines that the alternative location is preferred to the <br />proposed location, the applicant should be given the opportunity to formally withdraw. <br /> <br />If the conditional use permit is granted to construct the telecommunications tower at the currently <br />proposed location, it is Staff's recommendation that the rear yard setback variance be granted in <br />order to minimize the visual impact to the park and its users. The rear property line is shared with <br />Waste Management, and will not be developed with a use that would result in a conflict with the <br />proposed tower. Therefore, it is reasonable to assume that there would be no negative impact on <br />the adjoining MPCA property. <br /> <br />Board of Adjustment Action: <br /> <br />Accept the applicant's withdraw of the variance request, based on the re-location of the tower, <br />which eliminates the need for a variance; <br /> <br />-or- <br /> <br />Motion to adopt Findings of Fact # _ and adopt Resolution # _ approving the request, <br />based on the location proposed by the applicant. <br /> <br />Review Checklist: <br />Assistant Community Development Director <br /> <br />BOA: 6.7.07 <br /> <br />2 <br />
