<br />CASE # <br /> <br />e <br /> <br />CONSIDER APPROVAL OF ACQUISITION OF EASEMENTS FOR THE NW <br />TRUNK SANITARY SEWER EXTENSION <br />By: Leonard Linton, Civil Engineer II <br /> <br />Background: <br /> <br />The City Council authorized Bolton & Menk~ Inc to begin design of the infrastructure for <br />extension of sewer and water to petitioning properties on May 11,2004. The costs were <br />to be paid from the respective enterprise funds and be reimbursed from the bond proceeds <br />when and if the projects were approved. <br /> <br />The City Council directed staff to implement a public participation program on December <br />6, 2004. The program included property owners in the area identified as the NW Sewer <br />Extension. <br /> <br />The City held an informational meeting on February 7, 2005 with residents that could be <br />impacted by sewer ~d water extension. There were five (5) alignments under <br />consideration and all residents adjacent to the proposed alignments were invited to <br />participate in the meeting. <br /> <br />The City Council colurred with the Staff recommendation that Option 3 be selected as <br />the alignment for thid sewer extension at a work session March 15, 2005. The <br />recommendation was! based on review of the advantages and disadvantages of each <br />alignment and consideration of public comments received. <br /> <br />The City Council SelLted the alignment on April 12, 2005. Staffwas directed to notify <br />residents adjacent to IAlignment No.3 on June 9, 2005. The purpose ofthis notification <br />was to begin the prodess of acquiring the easements necessary for construction of the <br />sewer and water line~. The majority of the properties need to be acquired before issuing <br />the bids for the projeFt. <br />I <br />The City Council au~horized staff to retain Tinklenberg Group and Pro source <br />Technologies on Au~st 23, 2005. These firms will contact each property owner <br />individually, negotiate the necessary easement and prepare the necessary documents to <br />transfer the easements to the city. <br /> <br />The City Council has approved acquisition of 42 properties using this process to date. <br /> <br />Observations: <br /> <br />Utility and trail easements were obtained from Duane and Mary St. Hilaire for <br />c.onstruction of the sewer and trail. The drainage and utility easement and trail easement <br />descriptions previously acquired left gaps between the easements. The trail was <br />inadvertently constructed close to the edge of the trail easement. The property owner <br />contacted staff about ATV's trespassing on his property.
