The owner wanted to place a fence along his <br />property; however, the position of the trail does not permit placement of a fence without <br />impacting the trail. Staffhas drafted a new easement agreement that encompasses the <br />northeast comer ofthe parcel including the existing easement and provides a buffer from <br />the edge of the trail so that the owner can construct a fence outside of the easement. Staff <br />used the values derived for acquisition ofthe other easements on this project for <br />negotiating the price ofthis easement. The area of the easement is 2.05 acres, the city has <br />previously paid for 1.28 acres leaving a net of 0.77 acres to purchase. <br /> <br />Funding Source: <br /> <br />This acquisition will be funded from the Sewer enterprise fund. <br /> <br />Recommendation: <br /> <br />Staff recommends approval of the completed negotiations with Mr. St. Hilaire.
