-238- <br /> <br />(3) <br /> <br />(4) <br /> <br />(5) <br /> <br />(6) <br /> <br />(7) <br /> <br />(8) <br /> <br />(9) <br /> <br />(10) <br /> <br />(11) <br /> <br />eastern boundary of Jacobs lot, extended into Outlot B, on the east, and (c) the <br />western boundary of Van Norman's lot, extended into Outlot B on the west. <br />Existing topsoil located on Outlot B may be salvaged and stockpiled within the <br />area confined by the silt fence. <br />The existing spoil material shall be regraded such that a maximum 12 percent <br />slope shall rise beginning at the silt fence boundaries to a maximum elevation of <br />880 feet. A flat area at the 880 elevation must be between 10 to 20 feet wide. <br />The grading from the 880 elevation down to the pond shall be a maximum of <br />12%. <br />Following the grading described in (4) above ali surplus material shall be <br />transported off site or deposited into the pond along its northern or eastern shore. <br />(The engineer for the property owner estimates that there may be 1100 cubic <br />yards of excess material). <br />The City Engineer shall be notified that the grading has been completed and shall <br />inspect the grading for compliance with the above prior to initiation for the <br />placing of any topsoil material. <br />Salvaged and imported topsoil shall be spread to a depth of six inches over the <br />graded area. It is estimated that 500 cu. yd. of topsoil will need to be imported to <br />comply with this requirement. Silt fence shall be placed along the pond after this <br />step has been completed. <br />The City Engineer shall be notified once the topsoil has been spread to verify <br />depth prior to seeding. <br />The entire site in accordance with the standard receives fertilizer seed and mulch <br />according to MnDOT specifications. <br />A surety in the amount of $15,000 shall be deposited with the City along with a <br />waiver of trespass in favor of the City to enter onto the property to undertake or <br />correct any work as described within this agreement.
