Existing topsoil located on Outlot B may be salvaged and stockpiled within the area confined by the silt fence. The existing spoil material shall be regraded such that a maximum 12 percent slope shall rise beginning at the silt fence boundaries to a maximum elevation of 880 feet. A flat area at the 880 elevation must be between 10 to 20 feet wide. The grading from the 880 elevation down to the pond shall be a maximum of 12%. Following the grading described in (4) above ali surplus material shall be transported off site or deposited into the pond along its northern or eastern shore. (The engineer for the property owner estimates that there may be 1100 cubic yards of excess material). The City Engineer shall be notified that the grading has been completed and shall inspect the grading for compliance with the above prior to initiation for the placing of any topsoil material. Salvaged and imported topsoil shall be spread to a depth of six inches over the graded area. It is estimated that 500 cu. yd. of topsoil will need to be imported to comply with this requirement. Silt fence shall be placed along the pond after this step has been completed. The City Engineer shall be notified once the topsoil has been spread to verify depth prior to seeding. The entire site in accordance with the standard receives fertilizer seed and mulch according to MnDOT specifications. A surety in the amount of $15,000 shall be deposited with the City along with a waiver of trespass in favor of the City to enter onto the property to undertake or correct any work as described within this agreement. The aforementioned surety shall be utilized to defray the costs of any delinquent or deficient work.
