CASE # <br /> <br />Consider Adoption of Resolution Approving <br />Settlement of County Road 116 Condemnation Action <br /> <br /> By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />At a closed attorney/client meeting the Council considered a settlement with Thomas R. Kurak and <br />Pattimm Kurak concerning the acquisition of certain right-of-way for the construction of County <br />Road 116. This action had been appealed to the District Court. The terms of the settlement are <br />contained in the enclosed Resolution. <br /> <br />Enclosure: <br /> <br />Proposed Settlement Resolution. <br /> <br />Recommendation: <br /> <br />Based upon the mediation held on May 2, 2003 and the advise of the City's Counsel on this matter, <br />John L. LeFevre, Staff recommends adoption of the enclosed Resolution. <br /> <br />Council Action: <br /> <br />Motion to <br /> <br />Adopt Resolution 03-05- which is a resolution approving settlement of the pending Anoka <br />County District Court condemnation action docketed as City of Ramse¥ v.
