<br />A POLICY ON THE CONSTRUCTION <br />AND MAINTENANCE OF LINED PONDS <br /> <br />Introduction <br /> <br />The utilization of storm water ponds has evolved into a basic element of subdivision <br />design. Many of the storm water ponds constructed within the City are constructed below <br />the water table making them normally wet ponds which provides an aesthetic benefit to <br />the subdivision. For those ponds which cannot be constructed into the water table there is <br />an increasing desire to achieve the aesthetic function of open surface water by installing <br />and impermeable lining for ponds which would otherwise be dryas a result of percolation <br />through the sandy soils. <br /> <br />Lined ponds may lose the integrity of their liner through improper installation or damage <br />to the liner by activities from property owners or builders. A significant problem <br />associated with the repair of breached liners is the identification of the defect location. In <br />addition, the repairs to the liner are usually costly. The City hereby establishes this policy <br />to safeguard the taxpayers and protect new property owners from the cost of pond liner <br />repaIr. <br /> <br />Installation <br /> <br />The City will take an active role during the installation of the pond liners by inspecting <br />the liner for conformance with the approved plans and specifications. The installation in <br />conformance to the plans and specifications shall be insured through an escrow or other <br />surety acceptable to the finance director in the amount of 125% of the estimated cost of <br />the pond liner. The surety shall be held through the installation period which shall be <br />until certificates of occupancy are issued to all properties riparian to the lined pond. <br /> <br />Maintenance <br /> <br />Following the installation period, any repair necessary shall be undertaken as a public <br />improvement project and special assessed to the riparian property owner following the <br />procedure set forth in section 4.60 of City Code. <br /> <br />Effective Date <br /> <br />This policy shall become effective upon adoption by City Council. <br /> <br />Adoption Date <br /> <br />14 <br />
