Case #3: Public Hearing - Request for a Conditional Use Permit to Exceed the <br />Total Amount of Accessory Structure Square Footage; Case of Jeffrey <br />Sigler <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:17 <br />p.m. in order to call the public hearing to order. <br />Public Hearing <br />Chairperson Nixt called the public hearing to order at 8:17 p.m. <br />Presentation <br />Associate Planner Dalnes stated on May 6, 2007, the City received a request from Jeff <br />Sigler for an amendment to an existing Conditional Use Permit (CUP) to increase the <br />overage for accessory structure square footage at the property located at 17151 Baugh St. <br />N.W. The original CUP granted in 1999 allows Mr. Sigler to maintain a total of 7,240 <br />square feet of accessory structure space, which resulted in an overage of 2,140 square <br />feet. Since 1999, accessory space maximums have increased slightly; therefore Mr. <br />Sigler's property has a current overage of 1,940 square feet. The applicant is requesting <br />an amendment to the existing CUP to allow for the construction of an approximately <br />10,000 square -foot addition to his existing riding arena. This building would serve as a <br />storage area for multiple trailers and mechanical equipment. Currently, this equipment is <br />stored outdoors on a bituminous surface that surrounds the existing riding arena. Ms. <br />Dalnes advised at this time, the subject property has a 1,104 square foot attached garage, <br />a 1,200 square foot horse stable, and a 5,100 square foot riding arena, for a total of 7,404 <br />square feet. of accessory space. Additionally, there is a very substantial green house on <br />the property that is estimated to be approximately 2,500 square feet, including about an <br />acre of outdoor planting areas and potted plants. Because the green house is temporary in <br />nature, it does not factor into the total allowable accessory structure square footage. It is <br />unclear the nature of the use of this property. There is significant greenhouse activity on <br />the parcel. However, the applicant has stated that no business activity is being conducted <br />from the residence or the property. <br />Associate Planner Dalnes indicated staff is concerned that granting the request to <br />construct an additional 9,840 square feet of accessory structure square footage will <br />negatively impact the surrounding properties and the residential nature of the <br />neighborhood. Despite the assertion that the applicant is not conducting any type of <br />business from the property at this time, the construction of a total of more than 17,000 <br />square feet of garage space significantly increases the likelihood that business will be <br />conducted in these buildings into the future. Therefore, Staff is not recommending <br />approval of the CUP for an additional 9,840 square feet of accessory structure space. <br />Commissioner Brauer left the meeting at 8:19 p.m. <br />Citizen Input <br />—191— <br />
