Council would have to consider whether a variance would be granted to allow the trail to <br />be located in the right -of -way. <br />Ms. 'Gina ?, 5711 148 Lane NW, requested verification that the space for each home <br />will be 10,000 square feet. <br />Chairperson Nixt replied the lot area will be 10,800 square feet. <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to close the public <br />hearing. <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Brauer, <br />Cleveland, Hunt, Levine, and Trites Rolle. Voting No: None. Absent: None. <br />The public hearing was closed at 9:09 p.m. <br />Commission Business <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at <br />9:09 P.M. <br />Commissioner Trites Rolle asked if there is a concern or safety issue from the Fire <br />Department or anyone else about the cul -de -sac issues, the spacing, or anything of that <br />nature. <br />City Engineer Jankowski advised preliminary plat approval gives the applicant <br />substantial rights. If it is determined that the trail needs to be placed within the <br />subdivision with additional width on the cul -de -sac, the five lot subdivision could be <br />difficult to accommodate. <br />Commissioner Cleveland indicated there has not been discussion about how many people <br />the homes will accommodate. The public safety issue may be impacted if there are more <br />people living in the homes based on the number of bedrooms. <br />Associate Planner Dalnes advised this is a single family subdivision; the City can require <br />certain design standards within the PUD, but in general City Code does not allow them to <br />even mention the size of the home in a typical single family subdivision. With the PUD <br />there is some flexibility to say they want single level living. There are very specific uses <br />for the PUD, and it can consider including a range of housing options and things like <br />energy conservation, but not minimum or maximum sizes or the number of bedrooms or <br />bathrooms. She would caution against that. <br />Commissioner Cleveland stated Ms. Dalnes is referring to this type of consideration <br />being discriminatory. What she is saying is that there is a public safety issue as to how <br />many people can be accommodated in this small area of cul -de -sac with a short drive <br />going onto a busy road. <br />—258— <br />
