6. FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items <br />on the Site shall be as directed by the City's Fire Chief. <br />7. LIGHTING. Any lighting installed on the Site must follow the approved lighting plan and <br />is subject to prior approval by the City Engineer. <br />8. BUILDING FACADE. The Permittee agrees to construct the structure in accordance with <br />the approved building and garage elevations dated May 7, 2007. <br />9. REQUIREMENTS FOR BUILDING PERMIT. No building permit shall be issued until: <br />(a) the Permittee has signed and returned this Development Permit, (b) All final plans have <br />been submitted to the satisfaction of the planning and engineering department; (c) a <br />Certificate of Survey, including that survey information required by the CITY has been <br />supplied to the City Building Official; (d) all the financial guarantees and development fees <br />required by the CITY have been satisfied; and (e) the CITY has been provided with a copy <br />of all permits required by other agencies, including the Lower Rum River Water Management <br />Organization. Approval of the building foundation requires a certificate of elevation signed <br />by a licensed (State of Minnesota), professional land surveyor, verifying that the elevation <br />complies with the approved grading plan for the Plat. Foundation approvals will require a <br />certificate of elevation verifying that the actual elevation is in compliance with the approved <br />grading and drainage plan. The lowest floor elevation shall be at least 2 feet above the 100 <br />year elevation. No occupancy permits shall be issued until: (a) vehicular access is provided <br />including the installation of at least one layer of bituminous surfacing; (b) all utilities are in <br />place, operational and accepted by the CITY; (c) the City has been provided with a certificate <br />of grading for any lot with a slope flatter than 2 %. <br />10. FINANCIAL SURETY FOR REQUIRED IMPROVEMENTS. In order to ensure the <br />installation of the Required Improvements in accordance with City specifications and in a <br />timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter <br />of credit, approved as to form by the City, in the amount of Eight - hundred Thousand dollars, <br />and no cents ($800,000.00) which is 150% of the City's estimated cost of the Improvements. <br />Prior to the issuance of the building permit, all financial guarantees must be provided as <br />required herein. <br />Upon completion of the construction of the Required Improvements, the financial guarantee <br />shall be returned to the Permittee and the Permittee shall be required to provide the <br />landscaping maintenance guarantee described in Item # 12 of this Development Permit. The <br />determination of completion of the construction of the Required Improvements shall be made <br />by the City Council after consultation with the City Engineer. In the event the Permittee fails <br />to construct and install the Required Improvements as required herein, the City Council may <br />order the completion of the Required Improvements with City day labor and/or by letting <br />contracts for said completion and draw upon the escrow for payment. Only the City Council <br />shall have the authority to direct completion of the Required Improvements and withdraw <br />from the escrow account. The Permittee hereby grants permission and a license to the City <br />and /or its contractors and assigns to enter upon the Site for the purpose of completing the <br />Terrace Hill Apartments <br />Development Permit <br />Page 2 of 5 <br />—320— <br />
