<br />Motion carried. Voting Yes: Mayor Pro Tem Elvig, Councilmembers Dehen, Look, Jeffrey, and <br />Strommen. Voting No: None. Absent: Mayor Gamec and Councilmember Olson. <br /> <br />Further discussion: Interim City Administrator Nelson requested clarification whether the <br />ordinance should be brought to a work session, or whether staff should make revisions based on <br />the discussion tonight. Mayor Pro Tem Elvig indicated the ordinance should, be brought <br />forward; however, at some point there will likely be the need for a work session discussion on <br />tightening up some of these ordinances. Assistant Community Development Director Frolik <br />indicated there will be a lag with some of the ordinance, such as the number of vehicles, but <br />there is enough in the code to begin enforcement with this program. Interim City Administrator <br />Nelson indicated the ordinance will be included on a regular meeting agenda for adoption with a <br />follow up on the other items to be addressed. <br /> <br />Case #14: <br /> <br />Review Agreement with Railroad for Crossing Improvements at Sunfish <br />Lake Boulevard Improvement Project #08-20 <br /> <br />Civil Engineer II Linton stated the Joint Powers Agreement with Anoka County for the <br />improvements to Sunfish Lake Boulevard was discussed this evening in the Council work <br />session. The work will include widening Sunfish Lake Boulevard to two lanes in each direction <br />plus turn lanes to and from westbound TH 10. The railroad crossing will need to be upgraded as <br />part of this work. The signals will be constructed under a separate agreement with MnDOT. <br />Burlington Northern Santa Fe Railroad does all of the design and installation work within their <br />right-of-way and requires an agreement to accomplish this work. The draft resolution requires <br />review by the City Attorney. <br /> <br />City Attorney Goodrich advised he has'reviewed the draft agreement. <br /> <br />Civil Engineer II Linton noted that the signature page of the agreement includes Anoka County <br />elected officials, some of which may need to be updated. The cost estimate for the proposed <br />work is included in the staff report; there will be costs allocated between the County and the <br />City. <br /> <br />Councilmember Dehen asked if the upgrades to Sunfish Lake Boulevard that will be done in <br />August of 2008 will result in a no whistle zone. <br /> <br />Civil Engineer II Linton replied yes, the process to review that has been started. Part of the <br />designation to be a no whistle zone is the hard median for 100 feet on either side of the railroad <br />tracks, which is kind of counter to the work session discussion held earlier this evening with the <br />County . <br /> <br />Councilmember Dehen questioned if one of the criteria for a whistle free zone is a hard barrier to <br />separate the lanes on both sides of the tracks for 100 feet. <br /> <br />Civil Engineer II Linton replied yes, the hard barrier makes it very hard for someone to cut <br />between the gates while they are down. <br /> <br />City Council / June 26, 2007 <br />Page 31 of38 <br />
