<br />proposing to visit all of the commercial and industrial sites in the community to determine which <br />properties will need to upgrade their site conditions. The inspections would then be followed up <br />with a letter to all sites that are determined to be in need of certain improvements or corrections <br />in order to be in compliance with City Code, including a timeframe for compliance. <br /> <br />Assistant Community Development Director requested direction from Council on the following <br />Issues: <br />1. What is the Council's preferred deadline for compliance with the paving requirement? <br />(Standard timeframes will be utilized for other types of code violations.) <br />2. What are the consequences for failure to comply with required performance standards? <br />The current draft of the letter includes th~ standard procedure of forwarding the matter to <br />the City Attorney's office for legal action. <br />3. Does Council agree with the proposed policy regarding when it is appropriate to require <br />the installation of curbing on existing hard surfaces? <br /> <br />Mayor Gamec stated junk should be gone within 30 days. He would think the asphalt curb and <br />gutter should be in by the fall of next year, but he would question curbing. <br /> <br />Councilmember Look asked if this policy relates to Highway 10 or the entire City. <br /> <br />Assistant Community Development Director Frolik replied the policy is for the entire City. <br /> <br />Councilmember Look stated ,the City's public works facility with the temporary building, old <br />tractor, large dirt piles, and weeds growing all over the place, looks terrible. Some of these <br />businesses on Highway 10 are neatly kept compared to some of the City's property. Before he <br />comes on board with this policy the City needs to lead by example. If the City is not there with <br />the standards he finds it difficult to send out a letter requiring it of the businesses. <br /> <br />Councilmember Dehen asked when the City Code was passed to require curbing. <br /> <br />Assistant Community Development Director Frolik replied about 20 years ago. <br /> <br />Councilmember Dehen stated the way to address this issue is to provide a disincentive <br />monetarily not to come into cpmpliance. If they keep talking about it and do not enforce it they <br />will not get anything done. His experience is that the way to have disincentives is to require it to <br />be done by next year, and if it is not done it will start costing the owner money. He is concerned <br />about the City having hypocrisy and telling other people to meet the standards, and the City <br />needs to address that immediately. Any City properties that are not in compliance should be <br />brought into compliance. <br /> <br />Councilmember Jeffrey stated he agrees that they need to take care of the City property and <br />make sure their house is clean before going out to others. <br /> <br />Councilmember Elvig concurred. He stated he is not in favor of forcing pavement. The City <br />cannot even tell these people about the road, but they are asking them to put out a significant <br />cost.
