Attorney Goodrich stated that with Section 3, Subdivisions 2 and 3, it's not likely we would <br />declare a system nonfunctional as a result of these requirements. Probably the only way you <br />could not reconstruct the system is if you run out of land. <br /> <br />Mr. Schroeder reported that with regard to the definitions, staff is relying on a higher authority <br />such as the Pollution Control Agencies and the Minnesota Department of Health. <br /> <br />Councilmember Haas Steffen stated she would find it difficult to support this ordinance, <br />however, she was delighted the monthly charge was dropped. A cost has occurred and properties <br />have benefited and she believes the City should recoup the cost and the interest when that <br />property is sold. Land will be worth more because City sewer and water have occurred. She <br />suggested it is a big mistake not to have that in this ordinance. <br /> <br />Rick Christian, 7330 - 155th Avenue NW, Ramsey, stated that his impression is that he would <br />not hook up and he could sell his property with the benefit that the buyer does not have to hook <br />up either. <br /> <br />Councilmember Haas Steffen stated that one of the difficulties she had with the Charter <br />amendment is that there was no closure to it. She could not see another situation as what <br />happened in the Haubrich Addition happening again. She could not see any City Council voting <br />on sewer and water without 100% of the benefited parties in favor of it. This City cannot afford <br />to front the money because people will not pay for the utility. It's ridiculous - either they all <br />want it or Council votes no. We are making an ordinance for an isolated incident. It requires <br />people to go to the polls and vote for someone to be included in the MUSA - the City cannot do <br />it. <br /> <br />Attorney Goodrich offered to present the previous ordinance at the next City Council meeting <br />and Council could include the "due on sale" if that's their desire, and he would present the <br />Minnesota rules he mentioned. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to table action on <br />this case and direct staff to present the other version of this ordinance. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen, Haas Steffen and <br />Zimmerman. Voting No: None. <br /> <br />Case #4: Old Town Hall Rehabilitation <br /> <br />City Administrator Schroeder stated that some time ago, the City received an historical grant in <br />the amount of $16,000 to aide in the rehabilitation of the old town hall. In addition, $20,000 was <br />allocated from CDBG funds for renovation as was $80,000 in funds from the purchase price of <br />the lot. Staff has received the completed phasing plan and costs associated with the different <br />levels of improvements to the facility. The estimates have resulted in the need to determine at <br />what level the building should be renovated. He reported the cost to completely renovate the <br />structure would be $149,537. At the last meeting, Council reduced the CDBG funding allocation <br />by $20,000, leaving $96,000 available for this project.
