Abstain: CouncilmemberHaas Steffen. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: Proposed Adoption of a Moratorium Ordinance <br /> <br />City Administrator Schroeder stated that the narrative in the case presented to Council is the <br />exact same verbiage as was presented at the last meeting. However, at that meeting, it was <br />requested that Kennedy and Graven provide a report on the issue relative to the comprehensive <br />plan and zoning. He noted that Dave Kennedy is present and will present that report. <br /> <br />Dave Kennedy, Kennedy & Graven, stated that, with regard to the comprehensive plan <br />amendment, it is his firm's opinion that the Comprehensive Plan amendment became effective in <br />1995, because the whole amendment process was done in very strict conformance with the state <br />law. What's the effect of that on land use? Once a comprehensive plan has been adopted, under <br />the present law, all cities must conform their land use regulations in accordance with the <br />comprehensive plan by December 1998. That means the parcels within the area changed must be <br />brought into consistency with that plan by December 31, 1998. Staff related a practice that some <br />parcels had been treated as if they had been rezoned almost automatically and some went through <br />the rezoning process.
