Absent: Councilmember Haas Steffen. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Conditional use Permit for a Seasonal Outdoor Recreational <br />Facility; Case of Holm's Super Bowl, Inc. <br /> <br />Zoning Administrator Frolik reported that the City has received an application for a conditional <br />use permit from Mr. Holm to establish four volleyball courts and an outdoor bar area on the west <br />side of the Super Bowl structure, located at 6720 Highway #10 NW. She explained that the <br />applicant is proposing to eliminate the two existing volleyball courts on the east side of the <br />building and relocate this activity to the west side and increase the number of courts from two to <br />four. The applicant has stated that these courts will not deplete the amount of existing off-street <br />parking spaces on the site. The surrounding parcels to the east, west, and north, and the parcel <br />immediately adjacent on the southwest side of the subject property is currently zoned <br />commercial. The parcel immediately adjacent on the southeast side of the subject property is <br />zoned residential. Ms. Frolik continued that the applicant has submitted a site plan that proposes <br />to encompass the entire volleyball court area in chain link fence. This fence would be <br />established approximately one foot in from the common property line with the adjacent parcel to <br />the southwest. The actual courts themselves are set back 20 feet from this common property line. <br />In addition, Mr. Holm has entered into a purchase agreement with Mr. Williams, the owner of the <br />adjacent parcel to the southwest, to acquire an additional 60 feet of property. This transaction <br />will result in an 80-foot buffer between the courts and the newly aligned common property line <br />with the parcel to the southwest. Ms. Frolik pointed out that the applicant has proposed to plant <br />some trees along Ebony Street. City Code does not require screening in this area, but it does <br />require a 20-foot wide landscaped area along the road. The width of this landscaped area on the <br />Super Bowl site is proposed to be 15 feet and will be located between the chain link fence and <br />the courts. The site plan proposes to establish a spruce tree every 20 feet along this landscape <br />area. The applicant has indicated that this landscaped area could be widened to the required 20 <br />feet if he narrowed down the spectator area between Courts 1 and 3 and 2 and 4, however, staff <br />and the Planning Commission agreed that it was more appropriate to accommodate spectators <br />between the courts rather than increase the landscape area along Ebony and create an opportunity <br />for spectators to gather in this area also. To intensify the screening and noise absorption for the <br />adjacent residential parcel, Mr. Holm has agreed to establish six, 6-foot spruce trees on the <br />southwest comer of the chain link fence. Ms. Frolik reported that the applicant has indicated that <br />there will be lighting established on the courts that will direct downward and toward the Super <br />Bowl structure rather than toward Ebony Street. She noted that the proposed conditional use <br />permit restricts the hours of operation to no later than 10:30 p.m. She pointed out the findings of <br />facts within the agenda for Council to consider and noted that Mr. Bidwell of Holm's Super <br />Bowl was present. <br /> <br />City Council/May 13, 1997 <br /> Page 6 of 12 <br /> <br /> <br />
