He also recommended that any costs incurred by the City with <br />regard to resolution of these be reimbursed to the City by Alpaca Development. <br /> <br />Councilmember Beyer expressed disfavor with eminent domain proceedings. <br /> <br />Mayor Gamec stated that the parties can continue to negotiate and added that eminent domain <br />proceedings are a lengthy process and, therefore, should be started. <br /> <br />Mr. Goodrich stated that the passage of the resolution authorizing the eminent domain <br />proceedings does not actually start the action - that starts when the papers are drawn and served. <br /> <br />Councilmember Haas Steffen felt that the eminent domain proceedings is a very fair process. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to adopt <br />Resolution #97-05-132 authorizing eminent domain proceedings for the property required to <br />improve Llama Street between T.H. #10 and Riverdale Drive (approximately 514 feet south of <br />Highway #10), providing the parties can continue to negotiate to come to an agreement. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, Beyer and <br />Zimmerman. Voting No: None. <br /> <br />Joe Nathe stated he did not hear the City claim responsibility for any portion of this situation. He <br />speculated that Mr. Hilger would probably not have purchased that property if there was no <br />access. Mr. Nathe stated that Mr. Jankowski has said the access would be put on Shorewood's <br />property. He felt that his rights as a property owner were being violated if eminent domain <br />proceedings occur. He stated he bought that property knowing that was a limited access. He <br />added that it's negotiable but what they are offering is not going to buy it. He felt that farmers <br />are not treated fairly and he wants to be paid what this property is worth because it will open up a <br />lot of commercial worth to the City. <br /> <br />Case #10: 1997 Comprehensive Planning <br /> <br />City Administrator Schroeder stated that the City Council has directed that staff provide for <br />proposals from consultants in order to complete the new comprehensive plan prior to the <br />deadline of December 31, 1998. We have received three proposals which have been forwarded <br />to Council. Staff is asking for Council to set up a process to select one of the three proposers. <br /> <br />Consensus of the Council was to appoint Councilmembers Haas Steffen and Zimmerman along <br />with the Chair of the Planning Commission or his designee and the Chair of the Park and <br />Recreation Commission or his designee, the City Administrator and the Zoning Administrator to <br />conduct the interviews. Any other member of Council who is interested in attending is also <br />invited. <br /> <br />City Attorney Goodrich referred to his memo, dated May 21, 1997, in response to the MUSA <br />boundary and summarized its contents. He referred to a map marked "Exhibit B" as the correct <br />map showing the MUSA line.
