Ms. Frolik noted that the landscape plan <br />is rather sparse and staff has recommended increasing the number of planting materials and <br />designing a boulevard landscape along Sunwood Drive that will be compatible with that of the <br />Vision Ease site to the east. She added that this is a tax increment financing project under the <br />instant equity program the City has been operating. The City expenses toward the project are <br />recovered within the time frame of the TIF district. City staff and the Planning Commission are <br />recommending site plan approval. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to approve the <br />proposed site plan and development permit for Dakota Development contingent upon compliance <br />with the AEC Energy Park covenants and the City staff review letter dated May 29, 1997. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #5: Request for Final Plat Approval of Sunfish Pond; Case of G.M. Homes, Inc. <br /> <br />Zoning Administrator Frolik reported that John Lamoureux of G.M. Homes is requesting final <br />plat approval of Sunfish Pond. The property is situated in the northeast quadrant of the <br />intersection of County Roads #57 and #116. The proposed final plat for the 81 unit townhome <br />development is in conformance with the preliminary plat approved on March 25, 1997. Access <br />to the development will be provided from 142nd Lane on the north and 141st Lane or Wolfram <br />Street on the east. The Park Commission has previously recommended a cash payment to satisfy <br />park dedication requirements, but also requested the opportunity to review the plat one more time <br />after preliminary plat approval when the density and design are resolved. The plat will be on the <br />June 12 Park Commission agenda for confirmation. <br /> <br />John Lamoureux, owner of G.M. Homes, stated he is requesting that the plat be approved and <br />that they be exempt from the development assessment in the agreement. He stated that he has <br />had some discussions with other people who have dealt with other cities, and this fee is a bit <br />arbitrary. <br /> <br />City Administrator Schroeder stated that it's been the City Council's direction that staff escrow <br />any development assessment collected pending final resolution. Staff intends to come back at <br />the June 24 meeting with a proposed resolution to this but we ask that this be treated the same as <br />all the other developments. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #97-06-146 granting final plat approval to Sunfish Pond contingent upon compliance <br />with City staff review letter dated June 2, 1997, and the developer entering into the development <br />agreement with the City and with the proviso that funds collected for a development assessment <br />be placed in escrow with a decision to be made on that fund status by June 24, 1997, at the <br />regular City Council meeting. <br /> <br />Motion carried.
