On October 10, because of the :'quote <br />issues", the Finance Officer verbally advised an SMC manager not to proceed, however, this <br />information apparently was not communicated to the right person, as SMC did commence <br />chipping brush on October 14. This fact was unknown to staff at the time of the October 14 <br />meeting. The Council to date has not authorized a contract with SMC. However, Mr. <br />Goodrich's opinion was that SMC has a good legal argument to the effect that, notwithstanding a <br />lack of City Council authorization, it relied on the Finance Officer's apparent authority accepting <br />its October 3, 1997 letter proposal and a legally binding contract between the City and SMC does <br />exist. As might be expected, SMC has taken the position that it has a contract with the City and <br />wants to proceed. In the meantime, the City is advertising for formal bids for the brush chipping <br />work. These bids are to be received on October 31, 1997. He suggested that the brush chipping <br />be formally awarded to SMC and that at a subsequent meeting, all bids received be rejected. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to award a <br />brush chipping contract to Southern Minnesota Construction, Co., Inc. pursuant to their letter of <br />October 3, 1997 containing their written proposal and terms. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #10: <br /> <br />Adopt Ordinance to amend Section 9.11.18 (Grading, Mining and filling <br />Permits) of the Ramsey City Code <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Haas Steffen to adopt <br />Ordinance #97-15 to amend Chapter 9 of the City Code to allow for the construction of ponds <br />under certain conditions. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #11: <br /> <br />Appoint City Representative to Anoka-Hennepin Community Education <br />Advisory Council <br /> <br />Acting City Administrator Waite Smith stated that Dennis Carlson, Community Education <br />Director for the Anoka-Hennepin School District, has requested that the City of Ramsey be <br />represented on the Anoka-Hennepin Community Education Advisory Council. The purpose of <br />the group is to assist the district in planning and making decisions that would improve the <br />Community Education Program. Ms. Waite Smith volunteered to go to the next meeting and she <br />will be talking with Mr. Carlson to determine if the representative should be a Ramsey <br />Councilmember or if it could be an interested resident. <br /> <br />Case #12: County Housing and Redevelopment Authority Levy <br /> <br />Zoning Administrator Frolik stated that in the recent months, the Council has expressed some <br />interest in the need for senior housing in Ramsey.
