a public hearing to contest the charge. The Licensee has chosen to waive the hearing and enter <br />into a stipulated agreement whereby its license would be suspended for one day as a penalty for <br />the violation. He pointed out that the suspension could be up to 60 days, however, this is the first <br />offense of record. <br /> <br />Police Chief Gustafson reiterated that this is the first offense of record. He stated that in his <br />conversation with the lady who served the minor, she did not take the time to ask for <br />identification. Chief Gustafson agreed with suspending the license for one day - January 5, 1998. <br />He suggested this would be a "wake-up" call to all the liquor establishments in the City. <br /> <br />Earlier in the evening, Deputy City Clerk Thieling had spoken with Councilmember Haas <br />Steffen who was unable to attend this meeting. The opinion she expressed was that the <br />maximum penalty should be imposed. <br /> <br />Councilmember Beyer inquired how the date to suspend the license was arrived at to which <br />Chief Gustafson replied it was picked at random. <br /> <br />Mayor Gamec pointed out that usually on a first offense, an establishment is simply warned. <br />This is a stiffer penalty, however, not the maximum. He felt that a one-day suspension was <br />sufficient, however, if another violation occurs, a 60 to 90 day suspension would be called for. <br /> <br />City Attorney Goodrich stated that he and the Police Chief spoke with Mr. Bob Carlson, <br />President of Barnyard Entertainment, and he is very concerned and apologetic. <br /> <br />Councilmember Beahen felt that the one day of suspension should not be on a Monday as that is <br />not as busy a day as Friday or Saturday would be. <br /> <br />Chief Gustafson explained that this is one step more than a warning - it's a suspension and there <br />are serious ramifications for license renewal if it should happen again. <br /> <br />Councilmember Beyer stated that any further violations would constitute consideration of a <br />revocation of the liquor license for the Lighthouse Grille and Bar. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to enter into the <br />stipulation suspending Barnyard Entertainment Inc.'s on-sale intoxicating liquor license for one <br />day. The Mayor and Acting City Administrator are directed to sign the order. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen and Zimmerman. <br />Voting No: None.
