<br />9.12.22 <br /> <br />Violations <br /> <br />Subdivision 1. When, in the opinion of the Zoning Administrator, a violation of <br />the Code exists, the Zoning Administrator shall issue a written order to either the owner of the <br />sign, or the owner of the property, or tenant leasing the property, on which the sign is placed. The <br />order shall specify those sections of the Code involved, describe the violation and shall direct that <br />the violation be corrected within five (5) days from the date of the order, unless otherwise <br />specified by the Zoning Administrator. <br /> <br />Subd. 2. If the Zoning Administrator or Building Official finds that a sign is <br />abandoned or is structurally, or electrically defective, or in any way endangers the public, the <br />Zoning Administrator or Building Official shall issue a written order to the owner of the sign and <br />occupant of the premises stating the nature of the violation and requiring repair or removal of the <br />sign within sixty (60) days ofthe date of the order.9.12.22 Removal of Signs by the Zoning <br />"A",dministrator <br /> <br />Subdivision 1. The Zoning Administrator may cause the remDval of any illegal <br />sign, any sign remaining after a business pemlanently closes, or any sign not properly maintained <br />in cases of emergency, or after failure to tinlely comply ~'\ith v,Titten orders for remo','al or repair. <br />. f..fter remo'v'ul or demolition of the sign, a notice shall be mailed to the sign 0'.7;11& and o~;mer of <br />the property where the sign ~Nas located stating the nature of the '.york and the date on which it ~;,'as <br />performed and demanding payment of the costs as certified by the Zoning f..dministrator together <br />\vith an additional fifty percent (50%) for inspection and incidental costs. <br /> <br />Subd. 2. If the amount specified in the notice is not paid ~.vithin thirty (30) days <br />after mailing of the notice, it shall become alien agaL.'1st the parcel "'shere the sign ',],"as located and <br />shall be cCliified as an assessment against the property together with ten percent (10%) interest for <br />collection in the same manner as the real estate taxes. <br /> <br />Subd. 3. The o,,'<'"ner of the parcel upon ~."\hich the 8ign is located shall be presumed <br />to be the o';,ner of all signs thereon unless facts to the contrary are brought to the attention of the <br />Zoning /\dministrator. <br /> <br />Subd. 4. In case of emergency, the Zoning Administrator or Building Official may <br />cause the immediate removal. of a dangerous or defective sign ~sithout notice. Signs removed in <br />this mmmer must present a hazard to the public safety as defined in the State Building Code. <br /> <br />9.12.23 <br /> <br />Enforcement <br /> <br />Subdivision 1. Enforcement of the sign ordinance shall be conducted by the <br />Zoning Administrator and/or their assigns. Signs not complving with the sign <br />ordinance. as witnessed and documented by the Zoning Administrator. will be <br />subiect to the below procedure. <br /> <br />126 <br />
