<br />Subdivision 2. \'Vhen a violation of Section 9. 12.03 Subdivision 1 (Location) <br />is witnessed by the Zoning Administrator or other law enforcement officiaL the City <br />reserves the right to remove the sign from the public right-of-way immediately. <br />without notice. The sign will subsequently be discarded. <br /> <br />Subdivision 3. "When a violation of any other provision of this ordinance has <br />been witnessed. the following actions will be taken by the City: <br /> <br />a. Written Notice. Written notice will be made that the property OV\7D.er IS 111 <br />violation of the sign ordinance. and 5 business days will be given for corrective <br />acti on. <br /> <br />b. Notice of abatement or issuance of administrative ticket/fine. After the 5 <br />business days have passed. if the sign remains.. the City will follow Vvith an <br />administrative ticket/fll1e and/or a notice of commencement of abatement <br />procedures. in accordance with Section 5.08 Public Nuisances. <br />fu- <br /> <br />N otiee <br /> <br />Subdivision 4. The owner of the parcel upon which the sign is located shall <br />be presumed to be the owner of all signs thereon unless facts to the contrary are brought to the <br />attention of the Zoning Administrator. <br /> <br />Subdivision 5. In case of emergency. the ZOIllng Administrator or Building <br />Official may cause the immediate removal of a dangerous or defective sign without notice. Signs <br />removed in this manner must present a hazard to the public safety as defined in the State Building <br />Code. <br /> <br />9.12.2J.~ Appeals. To provide for a reasonable interpretation of the provisions of this <br />Ordinance, a permit applicant who wishes to appeal an interpretation by the Zoning Administrator <br />may file a written appeal with the City Administrator and request a hearing before the City <br />Council. a Hearing Examiner. in accordance with Section 5.08 Public Nuisances. The Gity <br />Council Hearing Examiner shall hear the appeal, make fmdings and take its action. <br /> <br />9.12.25 Variations. Request for variations from the provisions of this Section shall be <br />processed by the applicant applying to the Zoning Administrator for a conditional use permit, <br />which conditional use permit procedure shall be as prescribed in -Section 9.03.024 of the City <br />Code. <br /> <br />9.12.26 Conflict. If any portion of this Section is found to be in conflict with any other <br />provision of any zoning, building, fire, safety or health ordinance of the City Code, the provision <br />which establishes the higher standard shall prevail. <br /> <br />9.12.27 Severability. If any subsection, sentence, clause, or phrase of this Section, or its <br />application to any person or circumstance is held invalid by the decision of any court of competent <br />jurisdiction, the remainder of this Section, or the application of the provision to other persons or <br />circumstances is in effect and shall remain in full force and effect. <br /> <br />127 <br />
