<br />b. Notice of abatement or issuance of administrative ticket/fine. After the 5 <br />business days have passed, if the sign remains, the City will follow with an <br />administrative ticket/fine and/or a notice of commencement of abatement <br />procedures, in accordance with Section 5.08 Public Nuisances. <br /> <br />Subdivision 4. The owner of the parcel upon which the sign is located <br />shall be presumed to be the owner of all signs thereon unless facts to the contrary are brought to <br />the attention of the Zoning Administrator. <br /> <br />Subdivision 5. In case of emergency, the Zoning Administrator or <br />Building Official may cause the immediate removal of a dangerous or defective sign without <br />notice. Signs removed in this manner must present a hazard to the public safety as defined in the <br />State Building Code. <br /> <br />9.12.20 Appeals. To provide for a reasonable interpretation of the provisions of this <br />Ordinance, a permit applicant who wishes to appeal an interpretation by the Zoning <br />Administrator may file a written appeal with the City Administrator and request a hearing before <br />a Hearing Examiner, in accordance with Section 5.08 Public Nuisances. The Hearing Examiner <br />shall hear the appeal, make findings and take its action. <br /> <br />9.12.21 Variations. Request for variations from the provisions of this Section shall be <br />processed by the applicant applying to the Zoning Administrator for a conditional use permit, <br />which conditional use permit procedure shall be as prescribed in Section 9.03.05 of the City <br />Code. <br /> <br />9.12.22 Conflict. If any portion of this Section is found to be in conflict with any other <br />provision of any zoning, building, fire, safety or health ordinance of the City Code, the provision <br />which establishes the higher standard shall prevail. <br /> <br />9.12.23 Severability. If any subsection, sentence, clause, or phrase of this Section, or its <br />application to any person or circumstance is held invalid by the decision of any court of <br />competent jurisdiction, the remainder of this Section, or the application of the provision to other <br />persons or circumstances is in effect and shall remain in full force and effect. <br /> <br />SECTION 3 <br /> <br />SUMMARY <br /> <br />The following official summary of Ordinance #07-08-_ has been approved by the City <br />Council of the City of Ramsey as clearly informing the public of the intent and effect of the <br />Ordinance. <br /> <br />This Ordinance #07-08-_ replaces the existing sign ordinance with a revised sign ordinance <br />that eliminates all content-based regulation and addresses problems identified in the <br />administration of the previous sign ordinance. <br /> <br />147 <br />
