<br />recommending that this be carried forward to the current plan; more discussion of tbis can be <br />found in the site plan case. <br />Pavement Setback Variance Request <br /> <br />The E-l District also requires a 20-footsetback for all pavement and maneuvering area from <br />public street right-of-way. As a part of the Regency Pond 4th Addition plat, the applicant is <br />required to construct a cul-de-sac at the end of 1 48th Ave NVV. As proposed, the pavement shown <br />on the site plan has a 3- to 5-foot setback from the right-of-way of the cul-de-sac. <br /> <br />Because of the unusual shape of the subject property, it is difficult to locate buildings on the site <br />and accommodate the full setback to the cul-de-sac as required in the E-l District. Staff would <br />also note that the cul-de-sac will be used primarily for turnaround purposes. <br /> <br />Recommendation: <br /> <br />Based on the unusual shape of the property, site design considerations, and the proposed use of <br />the property, Staff recommends approval of the request for variance for a lesser bufferyard on the <br />northern property line and a reduced pavement setback to the right-of-way to the 148th Avenue <br />NVV cul-de-sac. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #07-08-_ adopting Findings of Fact #_ relating to a request for a <br />variance to bufferyard and pavement setback requirements in the E-l Employment District. <br /> <br />-and- <br /> <br />Motion to approve the request for a variance to bufferyard and pavement setback requirements <br />and adopting Resolution #07-08-_ declaring terms of same. <br /> <br />-or- <br /> <br />Motion to deny the request for a variance to bufferyard and pavement setback requirements based <br />on the findings of fact. <br /> <br />Review Checklist: <br />Asst.
