1996, funds from building amounted to about nine percent of the budget of the City. Without <br />building/development, taxes will have to be raised. <br /> <br />Mr. Hendriksen stated that all laws are subject to interpretation and ordinances will have to be <br />drafted for specifics. He suggested that a house built that is valued under $250,000 costs the City <br />money instead of making it money. <br /> <br />City Attorney Goodrich advised that the Charter Commission can pass this proposed Charter <br />amendment on to the Council with a recommendation to place or a recommendation to not place <br />this on a ballot or you could withhold comment and pass it on to the City Council for review. He <br />noted correspondence from the firm of Kennedy and Graven which provided a preliminary <br />review of this proposal and a decision will be coming later. <br /> <br />Commissioner Donovan stated that no one is opposed to working to maintain the quality of life <br />but this language is dangerously vague and it was written for the entire City by only a handful of <br />residents. <br /> <br />Mr. Hendriksen felt that the Committee who put the last amendment through got "burned" by the <br />ordinance the City proposed and he did not want the City to have that much latitude with this <br />one. <br /> <br />Mr. Dempsey commented that one of the three parties who benefited from the last Charter <br />amendment was at the meeting where the City Council enacted the ordinance relating to that and <br />that individual thanked the City Council, said he understood the reason for the ordinance, and <br />accepted the ordinance. <br /> <br />Commissioner Dononvan expressed concern that Mr. Hendriksen is circumventing all the City's <br />planning options by coming forward with such an amendment. He felt this action is thoroughly <br />unruly and negates the checks and balances the City has in place. In his opinion, the amendment <br />is almost unworkable - it's easy to write but extremely difficult to implement. <br /> <br />Mr. Hendriksen stated he left it vague for others to determine the specifics. He also felt that he <br />was being personally attacked. <br /> <br />Motion by Commissioner Swokowski and seconded by Commissioner Spain-Brist to table action <br />on this case until the legal advice is available and another Charter Commission meeting can be <br />called, preferably before the August 12, 1997 Council meeting. <br /> <br />Motion carried. Voting Yes: Chairperson Peterson, Commissioners Swokowski, Spain Brist, <br />Anderson, Donovan, Kiefer, and Vogt. Voting No: None. Absent: Commissioners Marn and <br />Netzloff. <br /> <br />Mr. Hendriksen stated that the language was presented to the City for discussion.
